Oh I wish it was that easy. That's just it, he says things like this to her and her 4 year old brother all the time. Just now I actually THOUGHT I had proof of some of the inconsiderate things he says to our small children. The problem is NOT in just this ONE phone call. He will see them again and he wont just stop talking like this to them because I ask him too. I just want him to stop hurting our kids weither it be on the phone or in person.

file contempt charges, hard to prove since you won't be able to use the tapes, but your ex will know that he can't do this without consequences, also maybe get your kids in to see someone, that way the can deal with their feelings about this whole mess and if you do go to court a third party will be able to relate their findings of the situation.

WANNACRY has a good suggestion. I'd skip the contempt charges at this point because you con't prove it. But I would give serious consideration to counseling - because (a) it will give your child a way to learn to deal with it and (b) will provide documentation.

It's been taken care of. She has talked to school counselor and is scheduled to talk to another. I apprently can't keep him from hurting her for now but I can atleast provide her some comfort from what she has been told. Thanks for the advice.
Just to add... yes I am a bitch to people who hurt our children and I personally don't think that is a bad thing. Most of us do what we can to protect our children or the ones we love from harm.
