What is the name of your state? Missouri. Well, me and my ex are divorced. Niether one has recieved a copy of the divorce decree. Yet she wont let me have my children when she is supposed to and hasnt let me have them since july of 2004. She says she wont let me see them till i pay her child support and we agreed that i wouldnt pay till we got the decree and send it to the child support enforcement agency to deduct it straight from my paycheck. Is there anything i can do to see my kids who i miss greatly? Is there any legal action i can take against her? Please help.

Well, legally she has no right to withhold visitation just because you aren't paying your child support. Your solution is to file for contempt.

However, at the same time you have absolutely no right to not pay your child support just because you haven't gotten a written copy of the judge's orders. Your kids still have to be fed, clothed and have a roof put over their heads. Therefore expect to be held in contempt yourself as well.

Why do you think that she has to obey the orders if you don't have to obey them?

For starters - do you have a visitation order?

Second - any agreement the two of you may or may not have made about when you'd start paying support is moot. You start paying based on when the judge and the order say you start paying - NOT when you receive the decree. You can rest assured that you owe the support, including back support and interest.

All you have to do is go down to the circuit clerk and get a certified copy of your decree.

The court is under no legal obligation to provide you with a copy. They do it as a courtesy most times, yes. But, it's ultimately incumbant upon YOU to get it.

Well one in the divorce it was agreed that child support would be paid through the child support enforcemet agency. So i believe im obeying that, i just wanna know how i can get to see my kids.

what you need to do is contact the clerk of court office and find out what the child support amt. has been set at,,,then start getting money orders, cashier checks,,etc but never send money directly because in the long run she can say that those were sent as gifts,,take the time and do it yourself because the child support probably have started from the time you guys went to court or depending on if your state have retro-active filing....be the bigger person and make the effort the sooner you start the quicker you probably can see your kids...

Go to the court and get a copy of the order. It's cheap, it's easy. Follow it. If you are denied visitation make a police report documenting it and then file in court for contempt.

Pay your child support to Child Supportment Enforcement Agency or you can be filed against for contempt as well.

Both of you need to do the right thing here and follow your court order.
