Eh.. it's not that bad. It's been a while since I've pulled it up and I don't even know if when I did I clicked on anything. I just found it actually a rather funny read. Not that the crime itself was funny in any way shape or form but I love how he has a knife and yet then appeals that he didn't have a deadly 'weapon' as the baseball bat he ALSO had isn't a weapon :rolleyes:

I just skimmed it.....it raises all kind of issues all over the danged place....and I am probably going to probe them....sigh...

But you are right....its ironic as heck.

The guy was under a restraining order...breaks into his ex's home...with a baseball bat and knife....hides in a closet to "see what happens"..watches her and new guy in the bedroom, comes out swinging....and then tries to claim self defense!!!!

PLUS...beats in the neighbor's door...plus...runs off with the kid...and the guy he attacked dies...

I have to admit though that his attorney worked hard on that appeal.

Yeah and he did win on the CS part. They wrongly (although I would morally disagree) assess him more then they were allowed to give to the slain man's ex wife for loss of CS.

You could ALMOST just seeing him snap or whatever if he'd just shown up there. But the fact there was a restraining order (so somewhere he wasn't even supposed to be) on him AND he was hiding in the closet (ever heard of laying in wait? :rolleyes: ) and then has the nerve to file that they didn't give the jury the option for self defense?? not to mention like I said.. claims that the baseball bat he beat the man with wasn't a weapon yet he had a knife on him too... It just amazes me at the lengths people will go and their lawyers will take it.
 
NOt really quoting anyone - just wanted to know how you guys do it - are you all laws students or do this for a living or what? Seems like you just love the law too.. that's really neat.

Thanks for any and all advice - I appreciate it. I did hear about Lexi but haven;t had but chance to get to learn it.

I'm currently going for my bachelor's degree in paralegal studies. I got interested in the law just like probably everyone else here. Well ok. I was INTERESTED since I was little but once the internet came along and I started going through my own legal things (divorce) I really started digging in. Over the years I've found how much is available on the interenet on ANY subject you want (my husband tells everyone if it can be found I'll find it on the net). Then in 2001 I found my way here also. I read up here, did my own research to learn and it went from there.

Will I do well as a lawyer? Personlity wise , maybe... money wise... maybe not so much...lol It's unsure if I should be a lawyer or a therapist...lol I will try to convince you to do what's right and FAIR more so then what the law allows you. What I mean is that when two people divorce if there's not a mention of taxes in the decree, basically the IRS takes presedence. Their rule is that the person the child/ren live with 50% or more of the time has the right to claim deductions. Now, I believe that it should be split (with a provision that CS is paid and kept current). A NCP pays taxes on that money when it comes through on their check, they then claim that money AGAIN on their taxes every year and pay tax YET again. In the meantime the CP doesn't have to claim it for anything yet then gets to claim the children. I don't find that fair. So, clients might not like me very well. Of course I would do what they wanted but this is just one example of how the law looks at things and how I do that differs and we all know there are those out there that it's their way or no way. Being a criminal defense lawyer would probably be a bad move for me.. :)

Most of us are ordinary people who for one reason or another have seriously gotten involved in legal research.

Sometimes its just because of people's own legal situation....sometimes its because someone has decided to go to school for law (like Tigger)....sometimes its because someone has familiarity with other areas of law and then gets "sucked into" another area (like me...lol)...sometimes its sheer determination and a desire to make a difference. Sometimes its simply a natural understanding of how law works (like
Stealth and many others here)....its often a combination of many of the above factors. There are some attorneys here too....and even though some of them get tough...the legal advice they give is very good.
