Absent a court order, it is very possible she CAN take the child out of state. However, there may be a RI statute that makes it unlawful for one parent to conceal the child or prevent visitation with the other. He may have to ask his attorney this question - or contact the police.

The problem with that right now Carl is that the child, absent a finding of paternity, has only one Legal parent. Therefore, if such a statute does exist, it's a moot point.

Unless RI considers being named on the BC as sufficient. Though, I suppose that would be a legal finding of paternity.

my husband's best friend has a child with another woman. THEY had the child IN marriage and when she left him for her ex husband/ex con/drug addict, my DH's friend got a lawyer and he told him to keep the child and get a temp RO not allowing mom to remove the child till there was a emergency court date two weeks later.

So, my DH's friend got the RO and kept the child from mom. When they got to the emergency hearing 2 weeks later the judge scolded the father for keeping the child away from the mom and gave mom custody even though dad had a good case against mom.

IN the end dad got 50/50 custody and the boyfriend of mom is not allowed around the child, but it just goes to show that sure, legally you can keep a child away from the other parent, but a judge may not like it and take it out on the parent who kept the child away from the other parent.

And it appears in this situation dad is not the legal father right now, so he could be heading into deep poopoo for doing this!

Also, to prove mom is an escort in court you have to get solid PROOF, otherwise a judge isn't going to listen to hearsay testimony!
 
Poster, does the mother have any documented histroy of mental illness? There was a recent event on Cape Cod where a mother with a history of mental illness took the child from Rhode Island to a Cape town, rented a motel room, killed the four year old girl and then herself. There was a competence hearing scheduled for three days after the murder/suicide.

A paternity test takes 3-10 working days. Go get one immediately. Get a lawyer and ask him to file for an ex-parte emergency order to return the child to Rhode Island and get order for visitation.
