My husband and I are about to go through a divorce. My ex friend is staying in our home because she left her abusive exhusband whom she had gone back to. For safety and because she was my friend is how she has ended up in our home rent free and not putting any finances towards the house in any way.

My husband got feelings for her and I caught him in the bed with her 3 weeks ago as of last night because he was 'mad' at me for something that should have already been resolved. Like he brought the issue up again to justify his actions. She hadn't even been staying in our home for a week at that point.

Do I need to kick this girl out because she has caused a lot of chaos on purpose in this house plus saying things hateful and nasty about me to a older man whom I've worked for he and his wife? OR should I wait for her to maybe legally be removed? I think my husband told her not to leave if I told her to. I've two boys in the house and they've already gone through enough chaos. They don't need anymore, so I want whatever happens to be the easiest thing.

Given the circumstances you have described, it would be a relatively simple task for your attorney to secure temporary court orders evicting your husband and his slut trollop and granting you the exclusive use of the home and its furnishing. Plus the use of family transportation.

And in addition, ordering the husband to continue providing the expenses necessary to maintain the home, giving you temporary custody of your children, and awarding you temporary spousal and child support.

Obviously this domineering bully of an “A” hole has you completely buffaloed. And he is going to continue to do so until you begin to stand up for yourself. Which you can start doing by seeking pro bona legal assistance.

First, she doesn't WANT the house, so there's no reason for her to refuse to leave it. If she wanted to stay there, it would be a different story.

Second, the kids are not his kids, so she does not need custody of them (she already has it) and they will not be dealt with in this divorce. Current husband will also NOT be paying child support (hopefully their actual father has already been paying for them).
