Why would you assume they would do that?
just got a letter from the 1st defendant's (the driver who hit me ) lawyer on friday. He is informing this case to the defendant's insurance attorney and said hope the insurance company will address this before the actual trial, which took place in early June.

So will the defendant's insurance company attorney bring this out of the small claim court to a general court then?
anything I shall do at the moment? shall I find a lawyer instead of carrying this myself?

thanks

I would sit tight for now. Most likely they are going to want to settle before it ever goes to trial. They know they're going to lose.

Completely agree with OHRoadwarrior here. Why do you care, just let the judge figure it out. Talk to your attorney and sue them. You want to be compensated, you shouldn't care who pays it! All the best!
thanks everybody for the help.
the result for the trial is out and it's in our favor.

the 2nd car is the only defendant liable. and he has 30 days to submit an appeal.

shall I show this result to his insurance company and claim for the damage?
