My husband and I are military members stationed overseas at different locations. I'm in South Korea, he is in Japan. My home of record is California, I was married in Neveda, my state of legal residence is Tennessee, and the last place I lived in the U.S. was Arizona. I thought I could file in TN but was told "no" since I have never actually lived in the state. He won't file but says he will sign all papers. Where do I file for divorce? Is there anywhere I can go to obtain residence and get a quick divorce?

My response:

I was doing some research on your question, and you wouldn't believe how complicated the jurisdictional / residence / domicile question is in this type of matter.

Unless there is something EXTREMELY pressing that you must obtain a divorce before you leave the service, wait until you're out and take up residency in the State of your choice. Believe me when I tell you - - wait until you're out of the service, from both a complication standpoint, to the money / Attorney Fee issue. Just forget about the divorce until you're out.

So, how's the DMZ doing these days ? Do you know the history of why you're there ?

Good luck to you.
