If that's OP's question, the answer is NEVER until the issue is adjudicated. I've read on this forum that OP might be able to claim the property through a little known law called adverse possession. I seriously doubt that will happen.

I really doubt that it would apply in a situation such as this.

Adjudication is the answer. IMO.
