When notarizing power of attorney documents in California, aren't both a signature and a thumb print required?

It is harder to deny you were present at the signing when you must leave your thumb print behind. It is much much harder to forge a thumb print.

I want to thank everyone for the interest they have taken. I think we're missing something here. I performed the notary acknowledgment 100% by the book and everything was done perfectly according to California law and the regulations set forth by the Secretary of State. Neither my employer nor I have any financial interest in the document. The defendant took the stand and perjured himself last week, so I can only do the best to convince the court he did sign the document. I spoke with an attorney provided by my insurance company yesterday and he said my risk of liability was low, but of course, that the defendant could decide to sue me or my employer in the future, but that his claim would be largely without merit. I am right and he is wrong. I am telling the truth and he is lying, period. I suppose the court will decide. I do have his thumbprint in my journal so it will be difficult for him to claim someone else signed.

I am glad your attorney was able to reassure you, and I wish you good luck in court, bokaba.

I wonder if you can get paid for being called as a witness?

Just an update:

I appeared as scheduled, but the plaintiff did not show. I suppose her attorney was upset and new counsel was substituted. The plaintiff's new (4th to be precise in this case) attorney says my testimony will probably not be needed and the hearing has been continued indefinitely.

It would be difficult to get a thumb print if he were not present. I think the whole thing was a stall tactic hoping I wouldn't be a able to appear or be able to produce the journal entry. This has happened several times in the past. In CA the public can make a line item journal entry request if they can provide certain information regarding the date and parties of the signing. Whenever I produce the entry, they no longer want it...they were just hoping I wouldn't be able find it to create doubt they signed.
