wrongfully put on a most wanted poster for the last year

I know what you are thinkin allready,(this guys on the most wanted poster for a reason and just doesnt know it) but its true i really really am , complete with my picture ,address,but what they failed to include was what i am wanted for ,and the reason is i am not most wanted in this county, in fact im not wanted at all in this county,as the D.A. ,sheriffs dept. and local dispatch have all confirmed.the sheriffs web site has this most wanted poster posted,and alot of people have seen it ,including my boss,....x-boss. its really true and i have been thinking about a libel charge against the county of san benito .anybody have a take?

Write them a certified (RRR) letter requesting they post a disclaimer on the website and issue you a letter of fact stating the posting was erroneous.

You don't have libel unless you can prove intent.

the fact about the diversion class is irrelivant ,mainly because its out of a diffrent county but even if it wasnt...it does not constitue being posted on that web site .there are plenty of violaters on the megans law web site who should outway any underthe influence 8 years ago charge but they dont.look for yourself on the megans law website zip code 95023

If you completed your diversion program, you wouldn't have been violated.
If you had responded to the sheriff when they came a knocking, you would have cleared this up.
That was how many months ago, what have you done to respove the situation?

ok maybe i didnt explain myself well enough last time, ill try again. i dont have ,and never have had ,any warrants out of san benito county.therefore the diversion class thing is irrelivant. and even if it was out of this county(but it isn't) its such a minor charge ,and common charge, that it doesnt constitute being on the most wanted poster, . i have signed the proper papers to have my info released to someone who works for the county and the sheriffs office cant find anything on me ,the D>A>'s office ,ditto. so now that we are past the whole part about why i am on there ,how much should i sue for? oh and to show libel you dont have to show intent ,just damage which ive suffered plenty of .

It is relevant, that there is an outstanding warrent based on your failure to complete your diversion program in another county, it doesn't have to be San Benito County. Shhhhhh, the State of California, unlike some parts of the country, has and uses computers :eek: Not only that, but counties communicate with each other in mutual aid contracts. You have no case for a number of reasons, so forget about collecting a big windfall. You are totally responsible for your situation. I suggest you get your you know what back to the county that issued the warrent, violating your diversion program and take care of business.

ok so in your opinion, seriously, you think that i should be a higher priority person for them to spend time , money, manpower to catch than all those violaters in my county on the megans law website?for a minor infraction 8 years ago in a diffrent county?that its obvious why im on this list ahead of murderers, rapists etc.?

My opinion or anyone else's opinion is a irrelevant. The warrant doesn't go away because you ignore it and it is not up to the court of common opinion to adjudicate the issue. There is a judge out there somewhere and you are at the top of his list, how special. :)

You are not going to find anyone less stubborn because I am citing the law and how it affects your situation based on the facts. No one can change that, that is why you haven't got any other answers. We cannot change the facts or the law to suit your personal desires. We are not Gennies here to nod our head and grant your every command. :rolleyes:

Quite frankly I don't touch the stuff, I also avoid the big purple one. :eek:
