i asked my esq. about that because i was just curious and she said its generally the mothers perogative if you and the father were not married. there is no law saying the baby must have his last name and it would only be an issue if he fought for it and even then he probably wouldnt get very far. My ex's bro. tried to have his son's last name changed to his and he didnt get it.
