Florida State So if my wife went to jail for a warrant for dangerous drugs from 8/10/23 can I go to the court house and tell them it was mine? And they let her out state attorney gets what they want a conviction..

You really need to discuss this with an attorney. Admitting to a crime you didn't do to try to get your wife out may not work out like you hope it will. It may be that both of you end up getting a conviction out of this if you do that. An attorney can advise on your options and how best to help her without putting yourself at more risk than you need to.

Has your wife been in jail since August 10 on the drug offense? Does she have an attorney?

It is rarely a good idea to confess to a crime you didn’t commit. If you know something about the drugs that could be helpful to your wife in her defense, discuss this with your own attorney so that what you say can remain confidential.

I know a guy who did that for his low-life girlfriend. He got a year in prison. She went merrily on her way, continued to use drugs, and got pregnant with other guys.

Really, really stupid.

If your wife is in trouble for possession, then it doesn't matter if they were yours are or not - "ownership" is not an element of the crime of possession.

Depending on the evidence that they have, doing this could make the problem worse, with BOTH of you implicated.

The best thing you can do is to get a lawyer. Try to get an initial consult with more than one.

A question not yet asked of 813Smith that has been puzzling me: Why?

813Smith, why do you want to “take the fall” for your wife and confess to a crime you didn’t commit?

Do you have young kids or something and decided jail might be easier than taking care of them while your wife is serving time in jail? That’s the only reason I could come up with that might make even a little bit of sense.

Where does it indicate that he would be confessing to a crime he didn't commit? The possibility does exist that they were his drugs rather than hers. I could see it either way to be honest.
