I think you are asking if you can force that nice teacher to do something for you for court. You cannot. Whether her Principal has a 'school policy' or just...'encourages' teachers to avoid doing affidavit/declarations is irrelevant. She said No.i asked a teacher from the old school if she could write a basic character reference for me, nothing biased, nothing involved, she said she'd like to, she really liked me and felt I showed I was a good parent, but her boss doesnt let employees do even trivial thing for court stuff. That is the same district as the school this other principal is from, and he is doing alot more than writing a character reference. How can one district have different rules for it's schools? Sorry to be redundant, i didnt want my question to 'get lost'. Just seems like if one school in district can do it, then the others can too, or vice versa.

It's not just a 'basic note'...that's what you are not grasping. ANY testimony you provide, means the other side has a right to contradict it. Meaning if she gives testimony (whether written, oral or otherwise) then she needs to be available for the other side to cross-examine. That could mean A LOT of time away from work. Principals don't all make the same school policies even if in the same county. That's why they are called 'school policy' and not District Policy.i wondered a little about that, I mean nobody wants to be subpoenaed...which is why it's easier to just write a basic note. I would not want to have to subpoena her, and can't say how she might be...she is a very decent person who I worked veyr well with and helped her alot as well, she asked me to teach art on volunteer basis for her class which I did several times, and also helped with a reading activity, so I know she likes me personally, etc BUT as you said noone wants to be forced to come to court, but it often ends up like that, which is all the more reason at why it's so unusual for the principal to volunteer to run down there!! I remember an attorney telling me often times people end up having to be subpoenaed, bc nobody likes court,...again, here's a principal running down on his own volition, seems a littel too eager!!
you know employees of the school system often have friends and acquaintances who are not employees of the school system- I think you ex may be friends with him- and he gets his kicks out of pulling your chain by saying the "principal" is gonna testify against you- as was said before - why the hell are you listening to your ex?just trying to figure out how one school district with 2 schools could have 2 different policies...that's all. It does matter, because my child matters... I only am concerned about this particular princpal bc he obviously has issues probably with women, but who knows, and acted very discriminatory to me all along, then found out he was having discussions over the summer with my ex....so, call that obsessed or whatever, to me it is pretty commonsense to see that for whatever personal reasons or issues he has, that he has been cohorting with my ex. Since i didnt do anything wrong it is a concern if he's going to court to talk about me, not much tosay. I guess I'll sign off. I found some of the advice very helpful...
