Take him to small claims. That is the purpose of the courts. You have a legitimate grevance. Landlords are not allowed to enter the house without notice. 24 hours in Colorado.

The law says you, tenant, 'own' the property over the term of the lease.

Unlawful entry a judge might consider valid lease termination. Try it.

**A: what the heck are you talking about? First, read the post. This is not an "enter the house" issue. Next the law does not state the the tenant "owns" the property over the term of the lease.
Boy, you sure live in fantasyland.

It really bothers me a lot - the landlord has also come into my house without knocking and inspects our garages without consent.
This was mentioned in passing in another of the OP's posts in this thread.
This would be reason to terminate your lease if done correctly (legally) which would take care of your trash-digging landlord issue.

Wisconsin Statute
704.05(2)
(2) Possession of tenant and access by landlord. Until the expiration date specified in the lease, or the termination of a periodic tenancy or tenancy at will, and so long as the tenant is not in default, the tenant has the right to exclusive possession of the premises, except as hereafter provided. The landlord may upon advance notice and at reasonable times inspect the premises, make repairs and show the premises to prospective tenants or purchasers; and if the tenant is absent from the premises and the landlord reasonably believes that entry is necessary to preserve or protect the premises, the landlord may enter without notice and with such force as appears necessary.

So unless he's claiming there was some emergency which would warrant coming into your apt. with no notice, then he's in violation of the law.

Yes it was mentioned "in passing" however the rest of his posts are definitely about the garbage issue ONLY. If he had continued on the vein of the entering problem he might have gotten more responses like this.
Thank you mailman, for at least having a statute at the ready.
Unlike Bsharp.

My apologies for deviating from the SOP. I know there are very knowledgeable people on this board and I certainly don't want to step on any toes however, I own rental property and that sentence jumped out at me.

My landlord also goes through my garbage weekly. I agree that everyone should do their best to recycle, but if a single piece of paper that could have been recycled goes into the garbage, our landlord chews us out for half an hour. Further, he insists that we put any food items into a plastic bag and then into the regular trash bag so that when he goes through our trash, the food doesn't get on his hands.

It's pretty riduculous.

If I were in that situation, I'd start leaving interesting items in the trash... LOL

Why oh why was a post from January 2006 unearthed?
That is a good question Oh queen. I Just on a whim looked up "unearthed" it being part of my history yah know; and found this thread and found it amusing, I got my appetite back. But the other ones these days would make me lose it again.

OOps I just unearthed it again. My bad. But it is funny. unlike some in other parts of this forum. Yah?

Sorry Queenofsand

Sorry for posting to a thread from Jan. 2006. It was my first time to this site, but it was a topic that was started that has been bugging me personally as well for 5 years!

I'll move on to something new.
