I spoke with the owner of the wrecker service and she initially agreed to repair it, but only if her "body guy" did the work. He wanted to repair the cracked plastic and repaint. I was reluctant to let her guy do the work, especially because painting would be involved and frankly, the part should be replaced not just glued back together.

I informed her that the damaged part could be ordered from the dealer prepainted for less than it would cost to have it "repaired" and repainted. She and I agreed that she could buy the part, and I would allow her body guy to do the replacement. I provided her the part # and cost from the dealership on 10/20, but I have not heard from her and each phone call I make to her I always get the "She's not in, can I take a message".

Is there a time limit that I would have to meet in the event I need to just go through my insurance? or that she can come back and say I waited too long and she won't cover it?

I genuinely believe that she is wanting to take care of it, but then again she could be blowing me off.

Adding this to your original post is easier. File the claim with your insurance company, and be done with the direct negotiations.

I just got off the phone with insurance (state farm) they are going to check on whether it will be covered under collision or comp. I'll most likely be making the claim as soon and I find out what I'm going to have to come up with for my deduct.

Stat Farm needs to do more training. If this involved an accident, then it is covered under collision. No ifs, ands, or buts. You didn't hit an animal, did you?

No accident happened. Damage occured when the car was loaded on a flatbed from the rear. The damage (scratched and cracked) was caused from the front end dragging on the pavement.

on the phone now.. state farm claims say it will be covered under collision.

My state farm agent gave the wrecker service a call see if she could get their insurance info before I file my claim and low and behold, the wrecker place calls me and tells me "state farm just called, go ahead and take the car to your dealership and we'll pay it"

Now that they are more responsive should I go ahead with the claim or let pay for it out of pocket?

I'll have to come up with $250 deduct (which I don't have) now with only the possibility that State Farm can recover the cost and refund me.

That's up to you. If you don't have the money, take it to the dealership, have the dealership contact them, and make sure that, before the work is done, that they will make the payment. Good luck.

To clarify this just a bit...make sure the dealer agrees to NOT hold you responsible for payment if the wrecking co. doesn't pay. I doubt you'll get that from them, which is why you really should do this through your insurance. You may have to pay the deductible, but you will get it back when the insurance company gets reimbursed by the wrecking co.
