I understand that landlords get fed up with som tenants.. But I have been a good tenant.. My landlord has had his share of lousy tenants here(I know i lived next door to 5 people He has had to evict)However, that doent make him the best landlord in the world.If he doesnt get a permit so a building inspector can check when they do the septic, which I seriously doubt he will, I will be calling code enforcement back. He got my letter, and told the neighbor(he couldnt be bothered to tell me) that it will be fixed within a week.

The problem is that Cvillecpm is a realist with many years of experience. AW and ACM base their advice on moral values and conjecture rather than laws of the state.
No, actually I did base my answer on the laws of the state. I also gave OP some info on what should have been happening during this time. I was commenting on Cville almost always giving advice pro-landlord and 99% of the time saying tenant is wrong no matter what.

Tenant is wrong to withold rent, however I don't see a judge in his right mind giving the landlord anything in court when he has let a hazardous situation sit for over a month without doing anything about it. As a matter of fact if I was the tenant I would sue the landlord for a return of a portion of any rents paid during this time. I would also call code enforcement on the landlord and make sure he got whats comming to him.

I seriously dought a judge would order an eviction in this case but you never know. I could see the landlord getting a good chewing out in court though.

Actually Cville is a FEMALE who has actually been trained in landlord-tenant mediation and run a L-T mediation service in CA....bet I'm the only one here with this type of training.
And I am willling to bet that 99% of the time the landlord got the better end of any deal you mediated.

Oh and sorry about the MALE thing. I thought you were a male. OOOOOppppps.

This is how I see it. Gabby illegally withheld rent.
Does not want to call code compliance for fear of having the house red tagged
Is in the process of purchasing property.

An eviction win or loose will greatly jeopardize her chances of closing.

If she were smart she would sit on this till she closes and then do whatever the heck she wants.
