i am a divorced woman going through a messy custody battle with my ex-husband (who is remarried) im currently living with a man that i been with for the last 2 years, who is not yet divorced from his wife or legaly seperated.. will his lack of action affect the out come of my custody case and or forensic evaluation that we have to go for ?

It could be brought up that you are living in an environment that is not in the best interest of the child. (for example) Adultery is not usually considered to be a positive thing.

dont miss understand, they are seperated,but not on paper and not divorced. she is aware of our relationship and that we are living together..

And again, you didn't ask what SHE thought of the relationship. For all anybody cares, she could be throwing you a house warming party and handing you birth control while you are on the way to the bedroom.

You asked if your relationship could be used against you in a custody hearing. The answer is yes, it could possibly be a valid point (and if your custody case is nasty, I suspect that he would be all over this).

GET RID OF MARRIED GUY.

What the PP are trying to say is IF you love your children and are REALLY interested in having custody of them, keep married guy out of your everyday life.

Why would you even risk it?
