Bought a Stolen Rolex on Ebay in January(didn't know)

I bouught a rolex on Ebay - Paypal processed the payment. I did not know that this watch was stolen and was told by the person that I purchased it from that her husband lost his job and was trying to make ends meet. I get it, take it to the jewlers and verify that it is real....however it was older than I was told. She said that she was not aware of that and brushed it off that her husband must have been told otherwise...I accpeted this and dropped it. I paid 2900 plus shipping which was a good deal for a used Rolex. This was sold out of Missouri.

I then get a call from the Sherrif department in July asking if I purchased a watch on Ebay. I told them yes and they asked me to send a pictulre. I told them that I couldn't since my digital camera was broken, however since they suppeneaed Ebay that there was a picture on the item when I purchased it. The detective basically told me that I would not have to give this watch back since it was out of state and I did not knowingly purchase stolen property- the lady I bought it from is now in prison for stealing and selling to pawn shops and ebay people.

After several phone calls ..it basically got dropped, until Friday when they called me back and told me that they had to many other cases and a state fair...so this case was side tabled. He then said that he (detective) had no clue what would happen..I asked what I need to do...as I already contacted Ebay and Pay pal and the time limit is over for any type of refund. The detective said that he would not give the person who had it stolen from them, my personal info or telephone number....

I get home last night and answer a call from the owner of the stolen watch who said that the sherrif's office is not going to do anything more for him and that he can file a civil suit against me since I have his property. He offered me $500 and that he would fly to FL and go to the jewlers to verify that it is his...or he would get an attorney spend money and I too would have to get one to defend myself. I told him that he should be going after the person who stole it..or the insurance company..he did not have insurance..

I do not want to lose 2900 and the watch...what will happen out of state, and do I have to be the loser of the money and the watch? I need advice please!

**A: wow scarry. I hope my Rolex is not stolen. Oh yeah, I bought it form a reputable dealer.

I am fairly certain that you would lose the case if sued.

Look at it like this:

Who should bear the burden of getting the money from the thief? The victim who had no choice of whether to be involved, or the buyer who did have a choice?

You trusted the thief at your peril.

you shoulda said you never recieved it in the mail or said there was no rolex in the package ...they know you have it...you know its stolen. you have to give it back. id would write letters to ebay and paypal. there should be protection and ebay should profile there sellers so this doesnt happen again. there might even be a way to sue ebay for letting a "thief" sell merchandise to you (buyer)

There is not - EBay is not responsible in this case.

I had the local Sherrif office call today

And..the saga continues! After the call onSunday from the person who had a watch stolen "it still has not been proven that it is his" No picture or seriel number has been provided...anyway...the Missouri department is not doing anything....so he called my local sherrifs office who told him that they would not come and get this property..he is out of state and Florida does not do that. I was told that he would have to get a court order and have it repossessed. That would cost him 2,000 for legal fees and the costs? Is that correct? The sherrif said that usually when this happens the person who lost or had the watch stolen will offer what they paid for it if they want it back. I still do not know if it is his watch or not...for all I know the person that I bought it from could have stolen more than 1 watch...I am grasping at straws.....

So if a court order is given and the watch is repossessed...will my credit card company reimburse me due to it being a stolen or what I call Fraud?

How could it be too long if I just found out in these last few months? I was told that I need a police report, and I have not been given anything in writting, only verbal conversations. Can you tell me what a court order costs?

Because your credit card agreement lists a specific amount of time to dispute charges. That time is based on when the charge first appeared on your statement.

Another angle to consider. Next time the alleged previous owner calls, ask if he was reimbursed by an insurance company for the stolen watch. If he was, he no longer has any legal claim to the property, the insurance company legally owns it.

With Racer72 talking about insurance, if the OP is a bona fide purchaser for value of the watch (How much was paid? How much is it worth?), his homeowner's insurance may consider this a loss. The problem comes up in used car sales and I believe that if the purchaser pays appropriately for a vehicle (and there is no indicia of a problem) later found to be stolen, comprehensive will pay the owner out the cash in many circumstances.

I see this is a rather old post, but I feel compelled to respond. So please forgive me if this response is too late:

Stop talking to any and everybody about this matter.

If they determine that you are in possession of stolen goods, they can follow the legal channels and come get said goods. Dont talk to the "victim", you never know, she may be in some kind of scam with the seller. Dont talk to the police, let them do their job without you helping them. If they come knocking at your door with a court order to get the watch, give it up. Until then, keep it on your wrist.

You're not going to get anything back from the CC company or e-bay/paypal. The transaction was too long ago.
 
just tell them that you lost it or it was stolen from you. seems like someone might have gotten $2900 and now wants it back. who is to say that the owner didnt know about it and now is scamming to get it back.
