I bouught a rolex on Ebay - Paypal processed the payment. I did not know that this watch was stolen and was told by the person that I purchased it from that her husband lost his job and was trying to make ends meet. I get it, take it to the jewlers and verify that it is real....however it was older than I was told. She said that she was not aware of that and brushed it off that her husband must have been told otherwise...I accpeted this and dropped it. I paid 2900 plus shipping which was a good deal for a used Rolex. This was sold out of Missouri.
I then get a call from the Sherrif department in July asking if I purchased a watch on Ebay. I told them yes and they asked me to send a pictulre. I told them that I couldn't since my digital camera was broken, however since they suppeneaed Ebay that there was a picture on the item when I purchased it. The detective basically told me that I would not have to give this watch back since it was out of state and I did not knowingly purchase stolen property- the lady I bought it from is now in prison for stealing and selling to pawn shops and ebay people.
After several phone calls ..it basically got dropped, until Friday when they called me back and told me that they had to many other cases and a state fair...so this case was side tabled. He then said that he (detective) had no clue what would happen..I asked what I need to do...as I already contacted Ebay and Pay pal and the time limit is over for any type of refund. The detective said that he would not give the person who had it stolen from them, my personal info or telephone number....
I get home last night and answer a call from the owner of the stolen watch who said that the sherrif's office is not going to do anything more for him and that he can file a civil suit against me since I have his property. He offered me $500 and that he would fly to FL and go to the jewlers to verify that it is his...or he would get an attorney spend money and I too would have to get one to defend myself. I told him that he should be going after the person who stole it..or the insurance company..he did not have insurance..
I do not want to lose 2900 and the watch...what will happen out of state, and do I have to be the loser of the money and the watch? I need advice please!
