Unfair Alimoney Expectations

I wanted to ask a question regarding alimoney and what people think is a reasonable outcome.

Here's a little background: I am about 1yr into my divorce. I have sole custody of our 2 minor children. Wife has court supervised visitation. We were married for 13yr when I filed. She has never worked, but did attend college. She has 6 years of college, but no degree. She changed majors at least 3 times. I paid all of her college expenses, last payment 4 months ago.

My question is: My attorney indicated I could expect to pay some alimoney for probably half the number of years married. Is this reasonable? My spouse comes from a wealthy family, but does not have direct access to any of those funds. She won't disclose her bank records even though directed by the court to do so.

And is she paying CS?

If you have already been providing her the means to be self sufficient, I would really fight for a very short term of alimony AND CS.

After SIX years of college she SHOULD be considered capable or nearly of entering the workforce.
 
I've read several other threads and the comment "it isn't illegal to be lazy" is mentioned a few times.

She hasn't been ordered to pay any child support at this time. The divorce isn't final yet. Currently, I'm shelling out around $3k/mo to keep her afloat. The problem is that I can't maintain that level of support indefinitely.

um . . . may I ask WHY you are paying $3k a month to keep her afloat??


is it court orderd? if not. . . . .

I am paying all her living expenses, car payment, insurance, some spending money, ... - all court ordered at the moment. I even have to pay her credit card min payments. Judge indicated that if I have overpaid, I will be credited at the final decision.

I was reading another thread and it indicated that if I pay her SS, then she may have to pay me CS. Does this happen often?

yes. Arizona is a shared income model state. that means that she WILL pay child support based on her income, or she will be imputed and income based on her ability to earn, and they will base child support on that figure. The only good part about the chance of her getting spousal support, is that it is tax deductible for you and is an added source of income for her, that will add TO the figure on which the child support is based.

If you have custody, you have the right to get CS whether she decides to work or not, and whether she is awarded SS or not.

This is a woman here .... I was awarded the custody of the kids with supervised visits to the dad - and yeah, HE was asking for spousal support, even thought we both had the same bachelor degrees - judge told 'em - get a job .... flip burgers, whatever - but get a job! He was told that he wasn't disabled, and if he was, then get a doctor to diagnose him as such, and then get on social security.

Suggestion here ... is she CAPABLE of working? Why didn't she work while you were married?

Most of us agree with him in premise, just not in hysteria.

She claims that she needs to go back to school (again) before she can earn a decent living. She is changing her major again.

If she hasn't worked in 13 years, then its quite likely that should WOULD need to go back to school to obtain marketable skills....or to at least finish a degree. Yes, you are likely to be on the hook for some short term alimony, but she can't expect you to foot the entire bill....she needs to get financial aid and student loans.
