Even assuming we can come up with some sort of argument why you shouldn't be suspended, are you prepared to file and litigate a lawsuit to compel the school to do it? They're not going to un-suspend you just because a few people on an internet forum say they should.
Even assuming you/we WANT to come up with... ;)

(And it WOULD be YOU! :D )

No, I will not seek legal action, I would just like information to back myself up when I am appealing the susupention (yes, you can do that). I am not just trying to get out of suspension and such, I dont mind out of school suspension, its just a vacation. the thing is, im doing good in school, and missing 10 days WILL make me fail. I personally am not willing to risk my future and fail my classes for a rule that the school chooses not to inform the students of in the official rule book which we sign and agree to, and then decides to enforce the rule when convenient for the school.

So no, I will not sue the school, but I intend to push for whatever rights I may have. I'd assume (regardless of what the punishment is being issued for) anyone that is participating in an online legal advice forum would be interested in the same for themselves and/or their families. Am I wrong in trying to defend my rights? I dont think so.

Since you are a minor, it would be your parents that would have to litigate this. Would they be willing participants?
My mother is on my side, not with the smoking, but with the fact that the school is trying to suspend me for a rule that is not valid. wouldnt any parent want their kids to be in school, rather than serving an unneccesary 10 days of OSS putting my grades and future at risk?

Kiddo, you're wrong in thinking you HAVE rights.
Sir, you are wrong to think I dont. Every american has rights.

Are you contributing at all to this thread? no. Id find somthing else to do with your time than utter a few worthless words trying to make a 16 year old feel worse.

You remind me of my 3rd son. Mind you, I love him dearly. He would look for every loophole possible for every transgression. I don't blame you - 10 days is pretty steep. Since you did it on school time, I don't think there is much to go on here. You signed a paper that says that you will follow the rules. You know that there is a final copy of the rules - you stated that earlier. Therefore, it can't be stated that you didn't know.

You don't have rights beyond basic HUMAN rights until you are a legal adult.

More reading. Less smoking. More class time. Less goofing off. Then you'll know something about your so-called "rights." ;)

But, I did not know of the final copy untill after the incident. I understand that theres not a whole lot i can do, but because there is an appeals process for the suspension, im at least going to try and fight my side, and id like to have the info i need to back myself up.

The document you signed was not an EXCLUSIVE document. Just because you agreed to not violate those particular rules does not mean that you are allowed to break other rules.
It's really not that hard to understand...then again, your mom has raised you this way...

That's so very cute of you, to read books and all.

Reality sandwich: YOU HAVE NO RIGHTS BEYOND BASIC HUMAN RIGHTS TILL YOU TURN 18.

Was that hard to understand? Do you grasp the lesson? Shall I keep the rest of the class waiting while you digest that?

There are no other rules, the rules we get in school we are told are the "SCHOOL RULES". The SCHOOL RULES are flawed, and are not what we were told. Is it really me thats not understanding the facts?

Also, dont even start on my mothers parenting techniques. how would you know how she raised me? keep her out of the discussion, you have no right to say anything about how somone raises their child.
