Time sensitive question...

Every time we went to court (FL), it was stated on the docs we recieved that there were to be no children present. Not sure how things are up north, or if they consider a 16 yo a child...but common sense dictates that you don't want a kid listening to Mom and Dad fight it out.

She txted me and said that her attorney was appalled that he'd brought the child.

I really think, given dad's behavior up to now, he's hoping the judge will hear the child... and that the child will be allowed to watch dad 'Win' this.

No children in the court room in Michigan. They aren't even supposed to be in the court house unless the judge/referee has order them.

When I was in court in August, the judge ordered my X to have my daughter produced. When she got to the court house, they had her sitting with grandma and the GF. She was then ordered out of the court room and into the hall. We had deputy escort out of the court house.

So, Majo's X might know that he has to cough up the child. But chances are he's going to try to have the judge hear from the child.

He should have just filed his modification and waited it out like the rest of us do. He's an a$$.

I just wish she had MY judge. I'd have a lot more faith in things then.

I don't think he'll follow any order that's handed down today. He's so convinced he'll win the modification based on nothing but child's wishes that he thinks he's above everything.

He's even told the 14 year old to not worry about doing homework or anything because he can 'start fresh' at his new school in Dec.

The judge said that her ex is not at fault for the child not returning home. He is not withholding the child, the child is CHOOSING not to return and he cannot be held responsible for that.

She does not have her child and will not have her child pending the modification.

When dad's summer visitation was over, he returned 14 year old, and NOT 16 year old. 16 year old was then enrolled in school in KS... school in MO (where child has lived since KG) has not released records to new school.

Father has continued exercising visitation w/14 year old, and returning him when he's supposed to.

I'm on the phone w/her right now and she is PISSED (understandably). Her attorney said "I don't know what happened." "I don't know what to do next" "I don't know if I can help you"

Parental kidnapping--penalty.
565.153. 1. In the absence of a court order determining rights of custody or visitation to a child, a person having a right of custody of the child commits the crime of parental kidnapping if he removes, takes, detains, conceals, or entices away that child within or without the state, without good cause, and with the intent to deprive the custody right of another person or a public agency also having a custody right to that child.

2. Parental kidnapping is a class D felony.

3. A subsequently obtained court order for custody or visitation shall not affect the application of this section.
