What is the name of your state? GA

What success would a CP have in objecting to a co-resident in the NCP's home? Could a custody order be amended to preclude contact with the individual? I have a family member whose Ex is intending to move into the home (it's his new GF's father's house) who is a convicted felon. He was convicted of the sale and distribution of drugs in a school zone no less! Can my family member actually be forced to send the kid to the home of a person who sold drugs to children?

The odds of success would be based on whether or not the CP could prove that the person was CURRENTLY a direct threat to the child's safety or welfare.

That would be hard, she's supposed to send the kids over for visitation, but when she asked to at least meet the people that will be living in the home with the child....the answer was "F' Off!". He's not currently in the home because he's still serving, but will be getting out soon on probation.

Then she has to send the child for dad's parenting time, and simply accept the situation. If and when she can ever prove that there is a problem, she can deal with it then.

She has NO rights to meet everyone that dad introduces the children to. How would she like it if dad demanded to meet everyone that she might introduce the children to?

Damn, it's like the professor in my business and employment law classes kept telling us: The courts aren't interested in what's right or fair......they're interested in the law.

So she just waits until Mr. Convicted-for-Drugging-Minors acts up, and then takes action... I guess that is hard to swallow, but the "legal" answer.

I don't suppose it would help her at all that that he's going to move without amended the custody agreement? She never found out through him, he's just going to up and move. Still within the State, but rather than the same town, he's expecting her now to drive an hour to get the kids. At what point to courts decide that it's the NCP to take over transportation if they simply decide to move. He still works here....and will commute every day... he's moving there for non-professional reasons, he just "wants" to live there. They have been sharing transportation costs....he picks them up and she gets them. But while he will just pick them up on the way home from work.....she has to make a 2+ hour roundtrip now.

Not "introduced", visitation is going to be taking place in his home. And the NCP is always harassed her about meeting her new husband (arguing that he lives with the kids), so I guess she knows EXACTLY how it feels.

Hey guys... isn't this the same poster that had mom and dad fighting over the video game?

I can't find the thread, but I am sure this is the one that claimed NCP was always demanding property from mom before seeing the kids.

Is this now the same mom wanting control over who is in NCP's house?

No, this is the same poster, with a question about a different situation. I have a family member that is concerned that her kids are going to be in the house with not only a convicted felon, but a convicted felon who gave drugs to children. She doesn't know the person, but apparently the NCP's own family have known the man for years and called her to warn her. Trust me, the one time he got caught was NOT the only thing he had been up to.

Yeah its the same poster but he punked up and deleted that thread. Are you going to delete as well? If you do, beware that NO ONE will ever answer another question of yours because we do not like it when we take the time to answer and then the information disappears.

And? Just because he was caught in a school zone does NOT mean that he was selling to kids. Its like just because someone is a sex offender does not mean they are a child molestor. PROVE that he is a danger to the child. An immediate danger.

That's why I was asking. She wants to know her options. And he was caught in the act of distributing to minors (in a school zone for the double-whammy).

I guess I just have to tell her to suck it up and wait .... maybe he is actually reformed :/

Mom really has to grow up. You are painting a horrible picture of her between this thread and the last one. Or you just happen to know several different contenders for the BU award.

So you are saying that if your children (if you have them, not trying to make assumptions) were going staying in the home of some shady character you would have no concerns what-so-ever? Since when is concern for the safety and well-being of children a bad parenting trait? I would rather have a parent that was concerned about the living conditions of a child than have a disinterested one.
