I have to say after reading you that you have severe psychological issues. You read papers, dont know what they mean, panic, went in for migraines, claim over sedation, want to sue, come nack and ask if drs can lie in dictations? are you kidding me? Please see a professional honey because you need it!!!!

Every post I read to me or anyone else is always SO RUDE. I have NOT seen one post where you helped anyone. I guess you must be a very BITTER person.

I did not ask if a dr CAN LIE during dictation....I said mine DID LIE...and I want to know what my options are legally if I can't prove malpractice.

I would NEVER ask someone to lie. I didn't know if certain dr's testified in cases or if my home town dr would need to. I was just confused on what to do.

I talked to one attorney today on the phone. She said it sounded like the hospital defiently acted negligent. She said the main problem is what I have had to go through to prove my problems now are from the hospital.

How do I find a doctor to state these problems are from the Hospital?....I thought attorneys normally found the doctors. I would be willing to pay if I need to for a doctor to look at my records or examine me..whatever needs to be done for him to testifie in court. Where do I find dr's to testify?....Does only certain dr's do this? I would appreciate any help on this.

Also, is it against the law for a doctor to lie in a dictation?...I know it would be my husbands word & my word against the dr's word...but, I am willing to do what I need to do to show how this dr lied....Any idea's on this would be helpful also.

Some Physicians are called to be expert witnesses in court. They will most likely be Board Certified in their specialty. Their services can be very expensive.

IMO, it would be very difficult to prove that the admitting Physician lied in their documentation. It is very possible that, given the pain you describe with your migraines, you were not in the proper state of mind to remember everything the Physician was saying.

Some of the OP's symptoms sound like severe anxiety. Some people, my brother and father, suffer severe anxiety when given certain drugs, ie. Percocet, anesthesias, etc. For my brother it was several months before he began feeling normal again. Just my 2¢.

Ummmmm... <shaking my head> Is this a medical or legal forum?!?!?! I have read quite a bit here since about 1pm today, but this one tops all. I have seen some serious issues, and others that anyone can tell are purely entertainment. This one.... makes me have seriious doubts! I have a legitimate question in the business section and can't even get a nibble of a response while this one appears to have everyone posting including myself! Well, I guess it was entertaining... Can we move along to other issues now.. like legal ones? :)

The OP is wanting to sue doctors and hospitals because of a reaction to medication that others have had as well. The word "sue" makes it a legal matter. I posted saying that their reaction could very well be a common reaction to different medications, thereby removing any lawsuit material.

THIS is a medical malpractice forum. THIS was a legal question having to do with malpractice. The posters on the MEDICAL MALPRACTICE forum may not know the answers to your question on the STARTING AND OPERATING A BUSINESS LAW forum. Some one with business/labor knowledge about your specific question may come along and try to help you. Be patient and don't hijack some one else's thread in an attempt to get us to look at your post (although, I guess it worked, because it got me to take a look ;):rolleyes:).

Thanks everyone for your help in the last few post I really appreciate it.

I had another attorney's office tell me that I was lucky to get out of this hospital because I do have the negligence ( I haven't wrote everything that happened on here)...but, not the long term disability part.

I know people say let it go ..( beleive me I know I should it is driving me crazy).

I do have a couple more questions - how many attorney's would you contact before excepting NO CASE ?

Are they a medical law anywhere that stops the negligence part?...If so, where do I go? A different type of attorney?

If not, where can I file complaints?

I still have medical records missing, etc.

When I was in the hospital I seen two different doctors. In my medical records I only received a dictation from one of the doctors.

Do both doctors have to make a dictation?

There should be documentation from each treating Physician in your medical record.

Have question for op

I guess I have 2 questions.

The first, what do you say is the malpractice incident? From what I see, your biggest complaint is that you were over sedated? What specific medications did they give you that you had requested to not get, and was it documented? What are your damages?

Second, did you sign a consent for treatment? If you signed a consent, it is going to be very hard to prove the doctor "lied in dictation." As a FYI, never sign something if you A) do not understand it and B) do not agree with it?

The drug that I requested not to take was depakote from the medical records it does not show I requested not to take it.

The other drug that I was hospitalized for and they have me anyway was Neurontin and yes that was in my paperwork.

As far as consent I did sign a form for consent, but the 11 different medications they were going to give me that I did not know about is not listed.

I received a letter today from the hospital. It says that if I wanted to get a statement from the other doctor that treated me while I was in the hospital I would have to contact him myself. I have made several request by signing releases, phone and fax. So, far I have received 3 sets of medical records and all three sets have been different. I wanted my full set before sending them to an attorney, but I am tired of fighting to get them all. The letter also stated I had received the complete report. I know that is not correct.

Is it my place to contact the other doctor to get his dictation?

They also want me to write a letter to their privacy officer about the incorrect informtion in the admitting dr's dictation and also the 2 signatures that are NOT mine.

I feel like I have worked with this hospital long enough it is time for an attorney. Do you think I am wrong?

What type of lawyer do I turn the inaccurate information in the admitting dr's dictation and the 2 signatures that are NOT mine?....Is that still a malpractice attorney?...or is that a different type of attorney?

Please help ...I am really at a loss.

Oh, as far as negligents. I could write a book on how I was treated in the hospital alot of it is in this thread.

After receiving my medical records I seen I had Blood Pressure Problems ( never had in the past), Abnormal EKG ( never had in the past & doesn't show done anything about it), by blood count levels some were low some were high ( it doesn't show they done anything) , a surgery consult ( that I don't remember at all), I left AMA before the surgery. Statements from the nurse stating "not doing well", & others. My stating I feel weird ( don't remember saying), & alot more. My discharge papers show they sent medication home with me which they did not. I could go on forever.

Since I have been home ( before I received my medical records), 3 trips to the emergency room with pains & cramps in chest. One over night stay because of this. I am now on a steroid cream - I have had a place on my leg we can't get under control since leaving the hospital. My depression, anxiety, etc. is much worse. Another book here.

Sorry to ask so many questions again. I am hoping someone will still help me.
