To update my situation, I spent 4 hours in court this morning. Long story short, It got pretty nasty between the mother and I but in the end I got what I wanted. Judge granted me visitation and slowly it would get better I suppose. I want to take this time to thank everyone in this thread for the advice and input you have shared, it helped me in ways you couldn't imagine. Thank you to TXrose for the lawyer, he was great! If you guys have any other advice you'd like to share with me about what or how I should proceed from here please share, keep in mind it's my first time being a father......

To update my situation, I spent 4 hours in court this morning. Long story short, It got pretty nasty between the mother and I but in the end I got what I wanted. Judge granted me visitation and slowly it would get better I suppose.
Wow, that was fast! Glad you got it worked out -- well, at least the legal part. :)

On November 27th, 2007 he had not the slightest clue what to do, and by December 20th, 2007 he not only got a court date but had a visitation order established?...during the time of the year when the courts are normally the most backed up?

While that's not impossible, the odds surely are not in favor of that actually happening. That's only 3 weeks.

While I don't know where in TX he is, I can tell you, I'm in the middle of LA County and it could in fact happen that someone gets TEMPORARY orders that quickly...more so possible if they had an attorney (the OP said that he retained an attorney) because an attorney would be able to navigate themselves around the court a lot better than someone who is pro se and just fumbling around.

Like I said, I am sure its technically possible. However he said that they had a 4 hour hearing, and getting a 4 hour hearing scheduled within 3 weeks must have meant that he had a killer attorney.

So maybe I'm starting to think like the litigants in my courthouse (sometimes I have to dumb myself down... no offense anyone), but he said he spent 4 hours in the courthouse, not that he had a 4 hour hearing...lol

So, let's say they filed some paperwork, judgy wudgy called them early, sent them to mediation, mediator sent them back to the courtroom, judge makes temporary orders until a hearing is set later on down the line...

Voila! 4 hours.;)

I had someone tell me they spent all day in court yesterday (which was technically true), but they weren't in my courtroom in the morning, because we were dark in the morning due to an emergency. I guess it's all in how you read it... LOL

To clear things up......

Initially, we weren't going to even have a hearing, but my lawyer went back there and asked the judge if he could get like a 5 min hearing for "visitation rights" just for the holidays. Next thing you know, it went for 3 hours. She brought witnesses and we both took the stand. Their stories didn't line up, their lawyer was a family friend and he was not prepared. All and all I was lucky they chose to go with the family friend lawyer cause he's the one that wanted to call out the witnesses. They were spreading lies about me and calling me a gangster. I laughed it off. The judge went ahead and awarded me visitation rights not only for the holidays but for every other week. He also said when my son gets older then it would soon be overnight stays. He then told the other side that they should get use to me because I will be around for the next 17 years of their lives. That was sweet. Support was issued ofcourse. Although it was a prelim hearing, I know that it was an important one. It basically gets my feet into the door and lets me control my destiny. Everything that happens from now on will be based on my actions not what they say about me.....that's was what I wanted from the get go**************to be a great father.....I believe I'm off to a stellar start considering my situation......

Well congrats to you! You really lucked out to get things done so quickly.

I didn't even notice how quick everything processed until you guys pointed it out. IMO, I felt like it took forever, but I guess that's what parents do.

Good job, dad! We're all very happy for you.

And remember, dont EVER let the mom push you around. Eventually, you should get 50/50 custody of that child, and you SHOULD fight for it...you deserve it!
