4 days ago my dog (great daine) broke through the front screen door and chased a lady up the front yard tree. We had the main door open at the time and have never had a problem with our dog breaking through the screen door. The lady showed up tonight asking us to take her to the doctor so she could get checked out. She says she is having trouble sleeping and her arm hurts from climbing up the tree. She says the dog might have bitten her on the ass but she has no brewse, teeth marks, or puncture of the skin. Our dog has all her shots up to date and has never attacked anyone before. In fact she is usually all bark and show till the door opens then she runs behind me. In a way I am happy to see my dog is a protector after all but worried that this lady is going to try and sue me now. We asked her if we could call the police to come out and take a report. She said she didn't want that because she is not a legal resident and is not supposed to be selling on property. So it turns out she is illegal and doesn't have a business license to sell her tamales on property and we also have signs posted on the entrances to the property that say no tresspass, no soliciting. Her husband then informed us that if we call the police that they will hire an attorney to handle the matter. What should I do? Do I need to look at getting an attorney? Will an attorney even take my case?

Do you have homeowners insurance? Sounds like you should hand it all over to them...

Not sure. Calling lender tomorrow to find out if we do and what kind. We live in a condo and the management company has insurance for the entire property.

The management company's insurance would not cover these kinds of things because they are not liable for your dog. It would be silly for you (especially in California) not to have homeowner's insurance. If you find that you don't have it, you may want to look into it. This is what it's for (your liability insurance). Call your car insurance company, they will usually be able to give you a multi-policy discount if you add homeowners to your current policy.

If not, wait to see if they do in fact sue you (and they probably will), consult an attorney.

Tell the woman you had no trespassing signs on your property and she shouldn't have been there. It doesn't sound she has any injuries and is just trying to get some money out of you. If she pushes you, let her know that immigration will be very interested to learn her name and address.

If not, wait to see if they do in fact sue you (and they probably will), consult an attorney.
This is highly unlikely considering the person is an illegal immigrant and will not want to call attention to herself.

Mortgage company let the homeowners insurance laps and didn't bother to check if we were up to date. So I guess we will just wait to see if she is going to sue us. How much am I looking at in attorney expenses if they decide to sue? Any way I could just present the facts that she broke a federal and state law and property violation to the judge to dismiss the case?

Her being illegal does not absolve you of your responsibility for the dog bites/bruises. The fact that the insurance company did not catch the fact that you don't have insurance does not remove you from responsibility of making sure that you have insurance. The mortgage company is only looking to protect THEIR interests anyway, not yours. We can't predict what a lawyer will cost, but many offer free consultations.

Sense she has no serious injuries, I think it would be hard for her to find an attorney that would take her case. Plus without a police report, it is her words against yours. I wouldn't worry too much about it, I don't think too much will come of it.

You need to get a secure screen door that your dog cannot break through.
