CS with other children in Texas

What is the name of your state? TX

My husband has custody of his 8 year old daughter. Mom pays 120 (just started paying on Oct 07) monthly CS. Judge did not order the 120 my husband agreed to reduce her CS from 300 to 120. My husband did the child support calc for Texas last niught and it said that if it was the other way around He would have to pay her 784 plus insurance??? We also have 2 children together..So we can not afford 800 a month in child support and pay or living expenses....he does not make that muchmoney and I do not work. Does child support not go down if you have other kids?

Again this is just a senerio...

In TX, support is calculated at a straight percentage of gross (net?) income. I believe it's 20%.

In this scenario, your CHOICE to stay home is not something that will impact the other parent of your husband's previous child/ren. It's a lovely choice if you can afford it, but if the situation was such that your husband became the NCP and had to pay more CS than y'all perceive that you can afford, you would certainly need to get a job.

Well I did work...but with 2 children in daycare all of my paycheck went directly to the daycare with NOTIHIING extra...so me working is not a option. As for him, if he has two other children besides his daughter would the support go down at all?

No. He shouldn't have had children he couldn't afford. You could get a job working an alternating shift. Or babysit/daycare.

Usually, child support will not be adjusted down to compensate for children born after the original order/original child. That varies a bit state-state and in certain situations... I know that in my state (NOT TX) subsequent children CAN be a factor, but it's based on which parent is filing for the modification.

I wonder if the older children have stopped growing or eating?

Original order was put in 2002 for BM to pay 120 monthly...NEVER DID. Modified 06 to 300...Never Paid either. She chooses not to work to take care of her other children. I worked to make sure my SD had the clothes, home, ect. She has been paying 120 a month for maybe 6 months this childs entire life...shes 8 now almost 9. I am not saying we should not have to pay if she ever decides to go live there. But 800 a month is much when there is other children to be feed as well. What happens if my husband and I get a divorce? He has to pay her 800 for one child and if I am the CP I dont get help?

This is one of those things that grownups consider before making major decisions, like having more children.

IF Mom became the CP, child support would be based on your husband's (the NCP) income, just as it is based on Mom's income now (if he had not agreed to the lower amount with Mom).

Her income is lower, therefore, her percentage of her income makes for a lower CS amount.

Why are you worried about this? It's not a situation that is happening.

Sure you do. You would get a set % of what is left of his income after he pays HER child support. And so on, and so on.

Again, I ask...why are you borrowing trouble? Are you actually contemplating divorcing your husband (or vice versa)?

Is Mom filing to modify custody?

WHAT is the point of dredging 'what ifs' up other than to add a dash of drama and outrage to your life?
 
HE agreed on it because AG and Judges will not make her do anything to support her child. Just letters and slaps on the wrist. She could make money if she choose to...but decides against it. This situation has not happened and most likely will not since the mom is a dead beat and the kid knows it. But its just one of those what ifs. I dont understand how a man can have 3 children one would get 800 and the other two wouldnt get hardly anything to help support them. So since he got a someone knocked up at the age of 18 and the mother decided not to take care of her dad and SM step up to the plate for the past 7 years whike BM has not as much baught a pencil for school...dad gets screwed in teh end since he is the father and not the mother?

When we went to have everything modified in 06 our attorney told us that it would be 20% of min wage minus 5% the other two children she has with someone else. But when it comes to my husband he does not get a percentage lowered since he has 2 other children
 
we were trying to figure things out last night so we would just know. Have you ever just wondered about something that could possibly happen to you but might not? Its good to know the outcome
