ex's stimulus check

What is the name of your state? WA

My ex owes me arrearage. I have never received his stimulus payment from the IRS. Am I suppose to? I do have a case with the Office of Support Enforcement and there are judgements on what he owes me.

Is there something that I must do to get his stimulus money from the IRS? Or is it only on his tax refund that they do that on?

Just wondering! :)

I just saw this q asked/answered here a day or two ago.

The answer is on the irs.gov website.

I never have recieved it in the past. That is why I asked. I did find this on the IRS website, for anyone who is wondering the same thing as me:

Q. I'm eligible for a payment but I still owe federal income tax from a prior year. Will my payment be reduced?

A. Yes. For this purpose, the Stimulus Payment is treated like any other tax refund. This means that part or all of your payment can be used to pay past-due federal or state income taxes or non-tax federal debt such as student loans and child support.


I wonder if he owes the IRS money, and they would get their money before child support?

A: General rule: Feds first, then everyone else.

Ask the CSE agency if they sent a refund intercept notice to IRS last OCT/NOV. If they didn't, any refund or stimulus payment will NOT be intercepted.

Does CSE have to send a notice to the IRS every year to intercept refunds for arrears?

And how did he file his taxes? Electronically or a paper return? If it's the latter, you're gonna be waiting.
Doesn't really matter. Even if it was intercepted, the OP is looking at several months before she sees it. They hold all interceptions for something like 6 months before disbursement.

Well....thats mostly true. They hold all interceptions that involve a joint return for about six months, but interceptions from single returns generally aren't held quite as long. (no spouse to potentially file an injured spouse form). Those they just generally hold until income transcripts are available so that they can make sure that all income was reported.

I know this is a little OT, but I was wondering if you know is intercepts for non tax federal debts are also held?

FEMA did an intercept, hubby filed injured spouse, and today I recieved a bill from FEMA showing a lessor amount than before. (It's been 8 weeks since injured spouse was filed, and we haven't heard from IRS yet.)

My apologies to OP for hijacking.

No, they generally don't hold intercepts for federal debt, because they can get those back if necessary, without too much hassle.

It can take up to 11 weeks for an injured spouse form to be processed.
