Mom is threatening friend with statutory rape charges

What is the name of your state? Illinois

My mom just told me today that she saw me and my friend-thing (he's not my boyfriend, but we fool around sometimes) kissing outside my apartment yesterday. I don't know what her problem is, but he's 18 and I'm 16 (female), and the age of consent in Illinois is 17. She says that if I have sex with him, she'll, "Have to take him to court." We haven't gone all the way, as far as penetration goes. But I want to know that if we do end up having sex and she (somehow) finds out and takes it to court, will there be something to try him for? I looked it up and I found these laws for Illinois:

Aggravated sexual assault for sexual penetration by an offender under age 17 with a victim under age 9.

Predatory criminal sexual assault of a child for sexual penetration by an offender age 17 or older and a victim under 13.

Criminal sexual abuse is sexual penetration with (1) an offender under age 17 and a victim between ages 9 and 17 or (2) a victim between ages 13 and 17 and an offender less than five years older.

Aggravated criminal sexual abuse is sexual penetration with a victim between age 13 and 17 by an offender at least five years older.


We could always deny it, but since he's only two years older than me, would the sentence be severe? The state takes into account the age of the offender.

The statute you posted state in clear language that it would be a crime. Is it sooooo important to have sex that you would risk your "friend" going to prison, where he will be repeatedly raped by other inmates, and upon release he would have to register as a sex offender for life? If you just GOTTA have it get a dildo.

This expression is just skanky. Have a little respect for yourself.

It's skanky. You obviously have no self-respect...That is unfortunate for you, your parents and the poor child you will pop out in the next year or so.

I don't see how it's skanky and shows that I have no self-respect. But it doesn't matter. Thank you all for your marvelous advice.
