What is the name of your state (only U.S. law)? VA
My employer does pay for our lunch break, they require the employees to stay in touch. This means we cannot eat in a restaurant, if we do so, we get wrote up. Now because of times(economical) they are writing us up for stealing time if we do go into a restaurant. Is this a violation of the NLRA.

Of course not.

In VA, they do not even have to GIVE you a lunch break, let alone pay you for it. They have no legal obligation to allow you to leave the premises. They are paying for your time; they get to make the rules about where you can and cannot go.

All true, unless the poster is 16 or under and working over 5 hours.... in which case they would not have to pay him.

The employer is telling us that by us doing this it is a form of stealing time from the company can this be true. After a warning, they are telling us that we can be terminated if we persist. Can they do this?

**A: look at it t his way. If you all get terminated, you can all go to the restaurant and talk about it.
