Lying to Get R/O

Well I guess it is what it is even if it's a load of crap that someone can do this. I am going to try to at least consult an attorney tomorrow regarding some of this so I know what direction to go in. Let you know what happens on Friday the 13th ugh what a day to have court!! Thank you for your help and answering my questions, better you than the posters in the other thread. They may have chewed me up and spit me out like they did my sister lol.
 


I finally get to see an attorney today. I have lots of court documents for him to look at. In those documents I have paperwork from her and her ex-husband interviewed with Family Court Services and I am mentioned in both. Her stating that I have never been violent to her and her children and that when she got back together with her ex the last time that he filled out all the paperwork for the R/O against me (the 1st one) and she told that to the judge and it was dismissed. Will this help me at all??

Without knowing all the allegations and the intricacies, we have no way of knowing if it might help or not. Your attorney is now in the best position to tell you that.

Yep you are right taking all my ammo (paperwork just to make that clear lol) gettin ready to head out the door now to the atty. Post later with more info. Thanks again.
 
Went to see 2 attorneys today for free consultations. One was not so great but gave me some pointers on how to present the evidence I have but had no intention of taking the case. I knew this up front because he generally doesn't do cases in that county which was fine just wanted info. Second attorney was great, I think I will be retaining him. I had all the evidence I needed to have it dismissed and thought he could get it dropped and encouraged me to file restraining order against her because the evidence clearly showed me needing one against her. Laughed a few times with everything I had said I did my homework. Actually my sister did, thank goodness for that. Asking for a continuance at the hearing tomorrow because he is not available for it. Let you know how it goes.

Ok now she has me involved (the sister). I took my nieces to their friends house down the road from the residence that my brother can no longer go to. We thought it would be best if he didn't take them so not to put himself in a position that would violate the R/O, even though it is over the 500 ft that is stated. When I left his ex passed me going the opposition direction whipped a u-turn and started to follow me, even blowing thru a 4 way stop to follow me closely too. I should have slammed on my brakes. I called 911 and drove straight to the police station, she stopped following me 2 blocks before reaching the police station. The police officer recommended I get a restraining order against her. His ex is really going crazy and this whole thing is getting out of hand.

Believe me we don't generally like this much "fun" as you said lol. We are trying to get that part of the fun out of our lives. We keep trying but it keeps following us around literally. Now I have a question, if I am to get a anti-harassment order against her do I go to the court house in my county or the county the other party lives in and where the incident occurred?
 
My hearing went well on the 13th, retained the attorney yesterday and awaiting my next hearing on the 27th. My sister has an anti-harassment order on her now cause she is causing crap with her now. I think this woman thinks my family can not be in the same county she is in. The police are tired of her calling 911 and just want her to go away. The police officer that spoke to my sister said she seems like a trouble maker and has repeatedly called 911. I wonder if when she was a child she has ever read the story the Boy That Cried Wolf. This is so sad. I truly think she needs some kind of therapy and hope she gets some it would make a big difference in her life.
 
So the story continues, went to court with the attorney on the 27th, she wanted another continuance! At first wanted 3 weeks (for what?) the judge said we only had Tues and Fri. so said April 10th, my ex stated her sons bday was on the 11th the 10th wasn't good for her. The judge went ahead set it for the 10th thank goodness the sooner the better as far as I am concerned. So she has statements from every single family member bashing me saying how violent I am but never stating how I was violent. Stating that I am verbally assaulting and yell alot. My family on the other hand refuse to lie and won't entertain these accusations her family has stated and write false declarations as her family has. She has even had her son of 9 years old write a statement WTF! I would also not allow my 9 yr old or my 2 16 yr old write statements these is an adult forum and will not involve them or ask them to lie for me or coach them into saying anything. This is becoming a circus show and my ex is the ring leader.
My question is how much weight does family member statements have?

with you having a lawyer, opposing family satements should all be reguarded as hear-say.

if i read right, you have her on paper contradicting herself. this may help.

if she doesnt have a lawyer and your lawyer isnt going and try to milk your wallet and get this drug out a while you should be allright but we dont know enough of any real evidence to guess what a judge will rule. allot depends on what side of the bed the judge wakes up on and if the judge/county is biased sexually.

im still going through a bogus RO. i wish you luck.

Retain the same lawyer. Your ex is setting up a pattern that is going to bite her in the butt big time. Ask your attorney if he can file anything against her to get her to stop this. What I don't understand is how she is even getting the temporary orders against you.

Hang in there she will eventually hang herself.
 
The day that the last one was denied I went back to my house but before doing that I went to the sheriff asked if she changed the locks can I break a window or the door? They said yes its your house and there is no order now saying you can't be there. I had called an officer out because one of my trailers was missing so an officer was out there after I pushed my door in to get into the house. She was not there at this time I did it she pulled up while the officer was there. That was on April 10th then on the 15th or 16th we got gas at the same station, she says I whipped in like I was going to hit her. And then the rest of the stuff is the very same as the last one. When will this stop? I have not spoke to her since the 11th when she moved her stuff out I even helped the guy moving her stuff. It has been very peaceful and my kids and I have just getting on with life, why can't she just leave it alone I don't want anything to do with her. I was a little shocked that a judge issued one as well but oh well. I am retaining the same attorney again this time if it is denied we are going to have her pay for the fees. This has gone beyond ridiculus!!
