I am NCP of 9yo girl. This year I have Spring Break. Our CO says per Indiana Parenting Time Guidelines. They say the following for Spring Break:
In years ending with an odd number, the non-custodial parent shall exercise the following parenting time:
[1] Spring Break. From Friday at 6:00 P.M. through Sunday of the following weekend at 7:00 P.M.
I just received an email from my daughter's dad that he will not be bringing her to the drop-off point (neutral location & 1/2 way point) on Friday, because he has to work. He said that he will drop her off on Sunday instead. My reply was that either I or my husband will pick her up on Friday. She will be in Daycare on Friday after school until X time. (Whenever stepmom picks her up). According to the ISPTG visitation starts at 6:00pm, so I know that I cannot just take her from daycare prior to 6:00pm withoput her dad's consent. Stepmom or dad could show up prior to 6:00pm, and I would be in the wrong...
I asked dad to bring her to the 1/2 way point for my midweek, and told him I'd make the drive for the weekend this week. His new excuse is that I will have our daughter for 3 week ends in a row (true, but it's the guidelines, not me) so he thinks that he is entitled to the weekend. I do not have an attorney. Should I file a motion to enforce visitation prior to Friday, or should I file a motion to show cause on Monday if he really does not allow me to have our daughter on Friday?
