Thanks for all of the replies.

I'm still not sure that I understand the process. We don't have to go to court for a judge to order ex (mom) to do the paternity test? We will just get a notification to do the DNA test? I offered to do a paternity test on the umbilical cord blood.... even paid a deposit, and ex wouldn't do it. So, I'm not sure that she'll do it if it isn't court ordered**************

I'm not sure who said this "she's done ALL the hard work so far". I agree, but it's not for lack of my trying. I can't help the fact that God decided that women would carry children. I would've done it if I could. I asked to take her to the doctor. I asked if she needed anything..... She just cut off all contact. I'm not sure what else I should've done?

And to whoever suggested adoption...... I haven't considered it at all because I am perfectly capable of taking care of my baby. Believe me, if I thought someone could love her more, or give her a better life than I can, I would be all for it. I am not against adoption at all. I have a huge amount of support from my family, and I have no doubt that I can provide for her and give her a happy life. Why would I give her up?

I will be certain to request the name change the first chance I get in front of the judge.

I digress; I guess my question is: We don't actually have to go to court for a judge to order the ex to do the paternity test?
A DNA test can be done in the court room. More than likely they'll do a cheek swab and will set the next date at that point so they will have the results. That's when all the deciding will start.

Just be set for the result either way..... And start saving your pennies, because you will owe at least to the date of filing. If the baby turns out not to be yours, keep saving. You'll have a nice little nest egg when you find the woman that you marry. Oh, and keep that rascal wrapped if you plan to do anything else before marriage.

He does not need this girl in his life for the rest of his life. I hope that the baby isnt his, just given to how this girl is acting. She's hiding way to much from this guy. If she didn't want a baby by him, then she should have went and got on the pill. One more imporant fact why was her mom letting her even sleep around to begin with at her age. She should have had a curfew and been in the house by midnight, and she should have taken her daughter to the health department, like most mothers do these days to make sure that these things don't happen. They are still kids that dont know anything about raising a baby. This guy is trying to do everything right, but she's not helping him out at all. They can do a swab test, you see it done on the time right there in the court room, or outside of it. I Think that the dna test will solve most of his problems, one way or the other. He will either be a father and get all of his rights, and she can't stop that because a judge will court order him to pay child support and get all of his visitation rights, or he wont be and can forget about it. If he paid for that deposit for that thing to be done, i would tell the judge and get that money back from her if the babys not his.if it is his then, I would say well thats your child support for one week.

hopekendrick, we're not interested in armchair quarterbacking the mother of OP's baby's life with strident suppositions about what she may or may not be doing, blah blah. Please stop trying to increase your post count by acting like you're a writer for a soap opera.

I wish him luck also, He will need it. I would go and get as much legal advice as possible if I were him, because you never know what she will pull. He needs to go and make sure that she even filed a petition against him.

Hope,
I don't know if you are aware, but this is a LEGAL forum, hence, he is trying to get LEGAL advice. Your nonsense is not helping him to get LEGAL advice. You really need to quit posting if you can't post something that is relevant and makes sense (i.e. not something that you would see on Days of Our Lives).

OP,
You seem to have your head screwed on straight. Go to court, get the DNA test court ordered, and go from there.

If the baby is yours, file for name change, joint physical, and joint legal custody. You probably would start off with a few hours a day so many days a week , but with time could move up to a regular visitation schedule.

If the baby is not yours, take it as a lesson learned. Keep your lil buddy wrapped up and be careful.

Either way, with whatever happens, GOOD LUCK.

Hello again. The papers were served to my house this morning. And apparently in Nelson County, Va, a woman can serve an "unknown father" with an "unknown address" with custody papers.

The petition literally says under Father's Name - unknown. This petition was served along with the three that I filed (paternity, custody, visitation). Her petition is for custody only. If the father is unknown, how'd they know where to serve the petition??

No question this time. Just thought I'd share, since everything that I've heard, read, etc has said that a woman can't file for custody because she already has it...

Thoughts on this anyone?

Thanks again for the help!

nope. she can file. but, yes she already has it by default. all she is doing is opening the door so YOU can have it! :D. she probably doesn't know that yet.

I have serious doubts that thsi babys yours, because she would have been wanting you there to sign them papers mad or not, so she could get child support. i think she probably gave the baby his last name or she gave it her last name, until she could figure out whisch one of you she could get the most money out of. I do like the fact that you are standing up being a man at a young age. Have you even considered the idea of adoption. It would be the best thing that you and she could do for that baby, if you are the father of it, the courts will make sure you do a dna before they give her any money from you at all after you are determined to be the the daddy. If you arent the daddy, say thank god, and go on with your life and go to college. one last thing use protection from now on, or wait until you are serious with a girl. You have all of your life to be parents! why young people think that this is all it is to life and rushing it is beyond me. Have a a life and do things in your life, before you start having ones to take care of. You never stop being a parent to a child no matter what the age, and i promise you you will be giving them money and helping them out well past the age of 18. then you will be doing the grandchildren. If you are going to do these things with awoman at least love her and be marrried to her.
I am sorry, but this is not a very useful post because clearly the mother is not going to agree to an adoption, and even if you could convince dad that its a good idea, mom is not going to agree.

You sound like the bitter new gf who doesn't want her bf to be a daddy to a previous gf's child.
