Need some advice please.....

I live in CA, but the issue takes place in Arizona.
My daughter lives in AZ with her husband, my grandson (6) and my granddaughter (1). My daughter is angry at me for calling CPS on her husband for alledgedly beating my grandson, his step-son. Several other concerned people called CPS too. Now my daughter is angry with me. She filed a protection order against me naming her and my grandchildren in the order. I went to the hearing to fight the protection order. The Judge removed my grandchildren from the order, leaving only my daughter named on the order. The Judge told me I need to get an attorney to obtain visitation with my grandchildren. I raised my grandson, from the time he was born, until he was 4. I financially supported my daughter for 3 years, in every regard. I put her through cosmetology school for 2 years. Now I have no contact with my grandkids. My daughter won't allow it.
Does anyone have any advice for me? I am so sad. Don't know what to do at this point. An attorney is out of the question. I don't have the money. I hear Arizona is a "pro mom" state, and that I will most likely lose if I petition the court for visitation.What is the name of your state (only U.S. law)?

What happened with the abuse alligations? Where is the father of the boy?

Mom is within her rights to deny you visitation. Arizona is NOT a pro mom state. The issue is as a grandparent YOU HAVE NO INHERENT RIGHTS. Troxel v. Granville is a United States Supreme Court case that puts you in a position that is not a strong one. You may not ever see your grandchild unless mom agrees. You will need an attorney however.

she doesnt have to. she decides who can have contact with HER kids untill theyre 18. if you file for gp visitation and lose, you can gurentee never seeing your grandkids again.

My grandson hasn't talked to me for several months. I was a key person in his life. I already know I may not see them again. I am looking for some hope.

They are still investigating. My grandson was removed from the house for 6-weeks and placed in a foster home. The husband can not be in the same house as my grandson right now. That's all I know. CPS won't tell me anything more.

Where is the FATHER to this child. I will not ask again.

I just found him recently in Colorado. He has not been in his life at all. He is not named on the birth certificate either. I put him in touch with my daughter, as he was concerned. Last we spoke, he was was going to take a paternity test to validate he is his father, and then try and obtain parental custody. But now he is no longer talking to me.

Based on your posts I would agree with OhioGAL and say that you have a very slim chance of a Judge issuing you visitation. But to even start an out of state GPV case will require 20K or so in legal fees...And you will probably lose.

A few months after the Troxel vs Granville case was published the USSC made another ruling (I am sorry, but I am drawing a blank on what kind of ruling it was called, but its where they rule on a case without actually hearing it) in the case of Dodge vs Graville, which was an AZ case.

Basically the ruling was that Troxel applied to AZ as well as WA, and that the AZ case was remanded to be heard based on Troxel standards.

Since then, AZ has been quite tight about using the Troxel standards...so that is probably why grandma believes that AZ is pro parent (pro mom was a poor choice of wording).

If grandma really believe that the child was in danger with the stepfather, then grandma did the right thing in contacting CPS. However, it was a dangerous thing to do. She would have been better off to find someone else to make the report.

Rather than suing, she needs to give mom some time to cool off, and then see if it would be possible to repair the relationship with her daughter.

I was sent photo's of my grandchild's bruised face. Broke my heart. In addition, my daughter called to tell me my grandson was covered in bruises, and that my grandson said his step-father did it. When you are a loving mother and grandmother, and you have basically raised your grandson from birth, your instinct is to protect, anyway you can. I knew when I gave my name that I would most likely be banished from my daughter's life, and my grandchildren's life, but it was a risk I had to take. If I helped my grandson, than I am willing to live with the consequences.

You did the right thing...Hopefully your daughter will one day see it and thank you for helping this poor boy.
