What is the name of your state (only U.S. law)? NORTH CAROLINA

I live in NC and I am a US citizen and so is my daughter however I am from England. I am thinking of leaving the USA with my 5 yr old never to return. I am sure legally my husband could have me for kidnapping but how easy would this be? What is the legal age the child must be for us to actually move from the country without his permission???? We are not seperated so nothing has ever gone to the courts.

The legal age is 18. Right now you are free to go to England with your child. If you have a passport for child. Of course then your husband would be free to run down to court and file for custody of the child and you would either need to return the child or risk losing custody more than likely. Any reason you feel like taking your child from their father?

You can certainly travel to England and never come back ~ you should just plan to leave your daughter with her father.

The US would have jurisdiction over custody matters regarding your daughter because England is a signatory to the Hague Convention. Therefore your husband could easily get a custody order in the US and England would honor that custody order.

It would NOT be kidnapping to start out with, but it could become kidnapping.

This is a really bad idea. Does the child have a passport? Dad needs to ask that it be returned to him asap. If you flee with the daughter, Dad could file for cusotdy and ask that the child be returned. The US has jurisdiction here. When you refuse to follow a court order and return the child this is when it is kidnapping and the FBI gets involved and issues a warrant for your arrest. Big trouble.

Why on EARTH would you do this to your child? What a horrible thing to even contemplate!

I'm going to be a rebel and give OP the benefit of the doubt here.

OP, is your husband abusive? Do you fear for your life or your child's life or safety? If so, there are many legal resources in this country that can protect you. But fleeing to another country will make you look like the bad guy (as you can tell from the responses here).
