What is the name of your state (only U.S. law)? North Carolina
I was injured last June when I fell at work. I completed all paper work and went to the doctor. My back starting killing me and I went to my doctor, I have had several procedures in which I paid for because I was scared I would loose my job over the workers compensation. Later I was transferred to another school, I am a high school counselor, and before I started working I explained to my direct supervisor, Principal, and central office of my back issues. I have been late many times, with a doctor's note, because I can not lift my arm but so high to get dressed, curl my hair, or even brush my teeth. Now my principal wants to document me for my tardiness. Can you legally do that if there is a documented illness/injury on file?

Yes. A workers compensation claim is not a get out of jail free card. You are still required to comply with company policies, including attendance and tardiness policies. A doctor's note has no force in law outside of FMLA.

Workers Compensation

Ok first of all I never asked for a get out of jail free card I don't understand how under OSHA (WC) and NC Labor Law article 95 can allow for double jepordy. If I give sick time and I am out because the employers facility was unsafe how is that legal for an employer to document me.

Because nothing in either OSHA or the labor laws of any state says that as long as you have an open workers comp claim you can be late as often as you want as long as you have a doctor's note. That's how it can be legal.
