This is not an argument of breastfeeding and visitation, just offering some knowledge.
A mom to a 4 month of child will find it nearly impossible to keep a valid supply and continue to breastfeed for a significant amount of time if she must pump mon-fri while at work, and every weekend, all weekend including overnight during the weekend. Maybe this isn't so for OP, but 4 month breastfeeders don't tend to sleep through the night, they typically wake to nurse. The supply will also not be established enough yet for mom to pump this much and keep up a supply enough for baby while breastfeeding and while away unless mom's body responds well to the pump which is really not typical.

ETA: Mom's supply is likely also not been established enough to not pump while at work and on weekends and still be able to nurse when with child. Usually this isn't able to happen until baby is at least about 10-12m old.
If a mother is dedicated to maintaining the child as breastfed, it IS POSSIBLE to do so while working full time. The key is using a double-breast pump, and maintaining a regular schedule to pump. In addition, find a sitter who is willing to work with you.

In addition, see if you can find a La Leche group - the support from those groups can help you get past hurdles, including THIS one.

My child breastfed for TWO years, while I worked FULL-TIME, with times where I hit 50 hours in a week. The child had ZERO formula.

Here's my question for the seniors;

Why do the NCPs visitation/parenting time ONLY on the weekends? I can see where the OP is frustrated because she has custody only on the days she works. Wouldn't it be more 'fair' (I know life isn't fair) to do a rotating schedule where mom gets some 'off' time too? :confused:

So after the judge took them (your attorney and his) into chambers did you decide to agree?


the fact that your baby is your life and what keeps you going is NOT healthy for the baby.


You are not qualified to make this decision.


Formula is NOT an excuse for him not to have overnights. As for separation anxiety YOU are NOT qualified to diagnose your child.

And unless you asked on the VERY FIRST HEARING DATE you waived that conflict.

My lawyer told me what went on in chambers...I did not agree, nor did my lawyer...the other lawyer is the only person who supposedly agreed...and thats what the judge went by.
At the first hearing, i was unaware of who the Judge was in regards to being related to my extended family...i did not know until afterwards.

As far as taking the child today, he cant. She was diagnosed with H1N1 which is very serious and contagious. My whole household has it at the moment. I took the baby to the ER Last night and was advised she stay home and do not go out unless necessary.. I have to follow up with her ped in 7 days. The ER here does not issue any kind of statement as to diagnosis to send home, they just send you home with the copy of the medical consent to treatment form.

You must admit that's an awfully convenient diagnosis - and the doctors invariably DO give you a statement of the diagnosis whether you're there, here or anywhere in this country.

(And with H1N1 they are REQUIRED BY LAW to provide you with not only the relevant information for you, but also to the various health agencies)

I thought it took time to determine if it is actually H1N1. At least what I've heard anyany, of course I've only given the shots not actually dealt with anyone with it . That I know of.

Most samples will need to be sent out to confirm the diagnosis although it's somewhat moot - the patient will be treated for flu regardless. Paediatric dx is more difficult but again they'd rather assume it is and treat accordingly.

I know there are RIDTs for H1N1 but the accuracy is much lower than for other flu strains.

Yep. As a matter of fact, when my 10 year old came down with the 'flu' (in the middle of her entire school getting wiped out with it), the doctor didn't even bother testing because they had so many kids in with 'flu like illness'. Sent her home for the week with traditional comfort treatment, advised what worsening symptoms to watch out for, and told me that if any of the other kiddos came down with it to just go ahead and assume they had the same.

Went home with a diagnosis of H1N1 even with no testing.

My luck...2 of the other kids and my husband all came down with it at the same time. What a crappy week that was. :(

OP...all I can say is 'how convenient'. I would have to think that if your 4 MONTH OLD was actually diagnosed with H1N1, there would be more concern from the doctors.

Either way? A diagnosis of an illness does not trump a court order. Dad can take care of her just like you can.

Dad has the right to have HIS child with him on HIS time. You do NOT have the right to make that decision for him. Nice try however. Did you tell dad when you took the child to the ER? Following a court order IS NECESSARY. Unless dad agrees the baby stays home, the baby goes. Or you face contempt. And the ER would issue a statement as to diagnosis. Your credibility is shot.

I am going to file the appeal and try and get the clerks transcripts. If i appeal it should postpone the judgment pending the appeal process

May the doctor call CPS on you and have the child removed from YOUR custody for medical neglect.

19 posts since you got back on today and suddenly the little one got diagnosed the H1N1 last night??? Nice:rolleyes:...

I left the ER AFTER the doctor came in and i was waiting on paperwork...i got the consent form and my copy..brought back my medical cards and they never came back in.. so i left..i think i was supposed to..im not sure...my baby was just crying and puking... it was bad.

Appeals should postpone any actions preventing the judgment from being enforced...at least thats what the clerk said when i got the form

So exactly how are you going to prevent Dad from taking kiddo today? You have no proof of anything, do you? Why shouldn't he take kiddo?
