I need some advice. Earlier this year I filed a charge of discrimination against my employer through EEOC...long story. Thought everything had been worked out but they still have not held up on their end of the bargain. Now they denied my bonus at work which I truely feel is retaliation because they even prorated new hires. Anyway, I called and gave my supervisor verbal notice of my intent to resign and was supposed to write out my resignation (as required in the employee handbook) when I returned to work in a few days. However, she called and told me not to come back, not to even work out the notice ( in a department that is already short staffed). My union has absolutely hung me out to dry all the way through all of this, even when I filed discrimination, they filed a grievance but didn't follow through with the timelines in the contract. I need help!!!!

I am sorry to have posted on here, I thought this forum was for people to try to get help with issues they may be having. I quit but the wrongdoing of the union and company is bothersome to me. Again, I apologize for trying to seek advice.

we can't help you if you aren't specific about what you are looking for.

you quit. problem solved.

are you looking to sue the company? your ex-union steward? did you not think you were represented correctly? and on what basis?

Rather then quitting, you should have just reported the denial of bonus to the EEOC for them to add that to your claims.

I am simply wondering if the company did do something wrong. They denied the bonus on grounds they would not release to me, like I said, new hires were prorated, I didn't get a dime, never told why, then denied working out my notice, I mean that's another payday while looking for a job. Our handbook specifically states, " Notice to resign must be submitted in writing within 2-4 weeks of date of resignation to immediate supervisor" It also states "If asked to leave work before the duration of notice is completed, you will be compensated for the duration of the notice" Nothing was ever put into writing and the union says "It's at the company's discretion" The union always says it's at the company's discretion, no matter the question. I am just disgusted with all of it, and I guess they were right, I got my wish, I quit. Just seems to me like something is just not right here.

The employer had every right and was legally correct in accepting your offered resignation.

That point has NOTHING to do with your other claims.

I'm new to all of this, so it IS legal to just tell me not to come back even though it is against their policy about writing it out? I was wondering too, I have always been a good employee...worked there for several years with excellent work evaluations...what do I do if they give me a bad reference? Will I know if they give me a bad reference? I guess you all can see from my posts that I am young and not had very many jobs, or problems at my job for that matter. I really appreciate anything you all can offer in the line of advice, if they are right, then they are right. I just feel that all of this relates back to the charge of discrimination I filed.

I'll try and make this clear for you.

It is perfectly legal for employers to (no matter what their internal policies say):
  • accept verbal resignations from employees;
  • not allow the resigning employees work out their notice periods; and
  • not pay the resigning employees for the notice periods.
If you have a complaint to make about your union, the correct thing to do is to contact the NLRB.

If you truly believe that the not paying you your bonus was a retaliatory act against you, the correct thing to do is to advise the EEOC.

Employers are legally allowed to say whatever they want about employees (former and current) as long as what they say is true, or they believe it to be true.

If you have questions about the possible negative references, you can work with a temporary hiring agency (choose one that is free for employees, not a charge for hire firm). They check references as part of their application process.

Having an EEOC complaint already on the table means you have the telephone number and contact to speak with about your case. Write down your question(s) and concerns before you speak with them.
