What is the name of your state (only U.S. law)? We live in Texas. Me and my ex husband have joint custody. One week on and one week off. On Christmas possession one parent gets our daughter starting the day school releases til noon on the 26th and the other parent gets our daughter from the 26 til the day before school resumes. How do we know which parents gets the child after the Christmas vacation is over? Who's time with our daughter is it?

Whoever's time it would have been if the rotation had continued without considering the holiday...is the parent who should get the child after Christmas vacation is over.

That's what we have done the past two years but all of a sudden he seems to think that whichever parent got our daughter for the 26 untill the Christmas vacation is over that suddenly it's the other parents possession? I tried to explain to him that it goes with the rotation of weeks through the new year.

Post WORD FOR WORD (sans identifying name) what you order states.

I tried to talk to him but because the rotation isn't in his favor he's making a big deal about it. Like I said it has never been a issue until now... 3 Christmas's later. Seems to me like it's easy to figure out rotation continues through the Holiday??

I would colour code a calendar of prior years to show how it was done so that dad can maybe understand better.

Continue to colour code it for future time to show that it does work out.

Dad seems to think that we have been doing the Christmas possession wrong the past couple of years. Which it makes sense to me that the rotation continues through the holiday but how should I get a legal advice to prove to him that the rottion continues??

You could start with posting what your order says about holidays, the rotation and whether or not the rotation starts over at Christmas.

Also, decide if this is a really huge deal for you or the kids.

I have no way of posting wht my order says. It does not say anything about the rotation starting over after Christmas anywhere. This is obviously a big deal because it changes possession times of we did it his way. Yet obviously his way is the wrong way. Rotation continues throught the holiday.

So...put your foot down with him. Tell him that the way you have been doing it is the correct way, and that you are not going to agree to change it.

He said he is going to call a attorney to find out. I can't wait until he does. M
I have tried to explain it to him but it only turns into a arrugement about the situation. I told him to call a attorney if he feels he needs to. Then for him to call me and an apologize for how he is acting.
