Alright, I live in NY, and I'm 19. My girlfriend lives in MA, and she's 17.

Now we haven't done anything physical yet. I've looked online and the laws are confusing the hell out of me.

So, if I were to drive over there and "know her in the biblical sense", and her mom decided to have a fit, would I be in deep **** or would I be okay?

If not I can wait till her 18th b-day, which is in November. Which I'd rather not do cause thats a ways off, but I;d wait if it means I don't have to go to jail. Which is my main concern here.

The age of consent in Massachusetts is 16, as specified by Chapter 265, Section 23 of the General Laws of Massachusetts, which states:

"Whoever unlawfully has sexual intercourse or unnatural sexual intercourse, and abuses a child under sixteen years of age shall... be punished..." MGL 265-23

However, Chapter 272, Section 4 sets another age of consent at 18 when the "victim" is "of chaste life" and the perpetrator induces them.

"Whoever induces any person under 18 years of age of chaste life to have unlawful sexual intercourse shall be punished." MGL 272-4

If you have sex with her before she turns 18 you are taking a risk, albeit a somewhat limited one.

The only case I could find that was actually prosecuted was this one in which a man offered $5 to a 14 year old boy to perform fellatio.

In one of the footnotes to this case, it was indicated that the Commonwealth took the position that "induce" means an attempt to persuade. In order for the state to prosecute you they would have to show that a) the girl previously led a chaste life and b) that she had sex with you due to your inducement and not from her own desire to do so. I think that either of these would be difficult to prove in court.

Of course, the only way to be absolutely safe is not to do it until she is 18.

BTW, do NOT take her to NY from MA until she is 18. If her parents are out to screw you then they will charge you with kidnapping.

Be sure to tell your child-girlfriend that you are primarily concerned with going to jail.

Not to mention that taking her across state lines for sexual purposes would violate the Mann Act. Then we're looking at Federal charges, and Federal prison.

Grown up people are able to keep their zippers closed. It's children and animals who are unable to control their urges. Which would you like to be counted as?

Kidnapping across state lines is also a federal offense (18 U.S.C. § 1201).

Also, the Mann Act was amended in 1986 to read "any sexual activity for which any person can be charged with a criminal offense." If OP could not be prosecuted in MA for statutory rape then I don't see how the Mann Act could be applied in this instance.
