What is the name of your state (only U.S. law)? OK

The mom has agreed to sign guardianship papers through a judge (instead of through the military) to allow me to keep my fiancee's son while he is overseas.

We (after a long weekend at the yellow ribbon ceremony) were able to speak to a lawyer who does not charge lawyer fees for soldiers being deployed, they only charge filing fees..

There is one question we forgot to ask though on Saturday when we spoke to her.. And today is a holiday so yanno.. Can divorce and guardianship be filed together? (oklahoma expedites divorces for deploying soldiers as well)

Also we found out that legally, I would be better staying here with all the kids while he is deployed.. Since we would have use of the lawyer for free (other than any filing fees) for that year he is gone..

oh one more thing we forgot to ask her, since jurisdiction for his son is in PA do guardianship papers have to be filed there? or can they be filed in OK? not sure if guardianship falls under the actual "custody" thing or not.. Thanks in advance.. I have no clue when it comes to guardianship and I can not find much on google to help with these answers.

Yes I posted before asking about a guardianship signed through JAG.. but someone said that we needed on through a state Judge.. so after we spoke with a Lawyer on Saturday we found out that information was correct.. but nevermind.. I forgot.. If someone doesnt know one thing but they might know another and they ask a question then they get no where.. so nevermind.. It was an honest question. And we are seriously trying to get all our ducks in a row before he leaves and deploys on the 4th of April.. Now if anyone can give me an honest answer to it then please do.. I do not need flamed or anything.. Thanks =)

He has been seperated for well over 2 years.. if you read previous thread I posted when asked about that kind of stuff, his sons mom has nothing to do with him. that is why she has agreed to do this because I have raised her son as one of my own for 2 years.. so does it really matter if we are "shagging" or not when it comes to the question I am asking?

Do his superiors know he is committing adultery? The military usually frowns upon that.

You need to understand that your lover is committing ADULTERY. And YES. This matters LEGALLY.

FYI: LEGALLY your lover can't be LEGALLY married and have a fiancé.

yes they know the situation.. they know that she walked out on him.. they know everything that is going on.. and with the situation they do not look down on him.. it would only be looked down on if I was married to someone in the military and we were hooking up.. but that has nothing to do with my question.. I am looking for an honest answer as to how it would work with trying to get the legal guardianship papers drawn up and filed through a court instead of through the military.. so again thanks to anyone who can help

actually, his wife left him for another man.. we didnt meet until after they were seperated and she was already living with someone else and pregnant with her second child by her boyfriend.. she does not care he is with me.. and we do not care who she is with.. I am asking this question for his son, not because I need flamed on how we are living our lives together

She (as in the soon to be ex wife) is wanting to sign them so she can marry the man she is with now. And as long as the divorce papers are finalized by March 30th, we can go into Arkansas and get married that next day because there is no waiting period there in order to get remarried..

Expediting does NOT mean that they can disobey statute or statutory times. Is the soon to be ex wife going to show up at the hearing? Are the divorce papers prepared? Does Oklahoma have a waiting period? Because if so you have to follow the waiting period for Oklahoma. Also what if the ex wife does NOT sign?

your "fiance" is the LEGAL father of this child. It is way more complicated than just going in to "get divorced". That is assuming that she's had the baby. If she is pregnant, no divorce.

No, it is going to be filed as a "no fault" divorce. Since he already has custody through PA and she does not want custody back.. Oh and Oklahoma divorces are normally done in 30 days.

Oklahoma has a waiting period to get remarried in Oklahoma, but you are allowed to travel outside of Oklahoma (in this case Arkansas) to get married. You do not have to be a resident of Arkansas to do so.

Trust me, she is wanting to sign because of the legal issues with her other two children. Plus she is wanting to marry her man ASAP.

so the question is this though: Does guardianship have to be filed where childs jurisdiction is? or since it is guardianship that can be done anywhere? I already know everything I need to know about being able to go to Arkansas to get married and all that.. just the guardianship thing is what I cant seem to find anything about.
