What is the name of your state (only U.S. law)? California/Utah:

My 13 yo daughter wants to live with me in Utah. Her mother wants no part of it. My daughter has begged her mother to allow her to do so. I really can't do anything. I don't influence my daughter. I listen to what my daughter wants, but I'm stuck. Does California use an Affadavit of Preference?

Only in addition to a change of circumstance. From your post, you have none. AND you want to move the child out of state.

I agree, you aren't articulating any change in circumstance and a custody change that would remove a child from the child's home state would be the hardest kind of custody battle to fight.

Thanks, was just curious. Daughter hates it where she lives, but what do you do? Thanks again

You teach her coping skills to deal with unpleasant surroundings and situations :)

Frankly I doubt there's a 13 year old on the planet who hasn't expressed an insane desire - nay, need - to live elsewhere at some point..

dannyt is living proof that as precious a gift as freedom of speech is, not everyone is equipped to handle it. Too bad it can't be added to the sticky (for those who actually read it) to ignore everything he says.
