What is the name of your state (only U.S. law)? Virginia.

I recently left my wife and she now wants me to pay her back all the money she spent on moving me and my kids (from earlier marriage) to the US from England. Visa applications, medical exams, flights and moving fees. Things like that. I assume she doesn't want me to pay back money that she spent on moving from the US to England and her move back to the US. She also paid off some debt I had in England with her own money before we left for the US. We were married (still are) when this took place.

If you were married when these expenses were incurred, she can ask and you can stick your fingers in your ears.

Her father is actually my sponsor. And we were married in Virginia in February 2009. She then moved to England in March 2009. We lived there together until a family member offered us a rent free house on 20 acres of land that was too good to turn down. She used her personal money to pay for mine and my two kids Visa applications etc. While we were in England we lived soley on my income. She did not work there. We are still married. I moved out to stay with friends 3 weeks ago. I intend to stay separated and then want a divorce from her. I will then file to have the restrictions removed from my marriage visa, so I can stay in the US with the kids.

You should have a chat with a local attorney. Your marriage is very short and I'm assuming your residency is still conditional, yes?

Though it's not easy to prove, she may try to pull the "marital fraud" card.

She would have a very hard time convincing anyone that it was marital fraud, simply because it wasn't. I have more than enough evidence to support the fact that we were very much in love and that both parties entered into the marriage expecting it to last forever.

I am very worried about contacting an attorney, as I only make between $250 and $300 per week at my job and while I dont have any major bills right now, the transmission has gone on my car and I do not have any savings. Could you give me a guesstimate of how much a chat with an attorney is likely to cost me? Thanks.

Maybe consider picking up some part time work to pay for the divorce.

Dad-in-law doesn't sound too smart and should have known better. Wonder if wifey will do the right thing and pony up the money to Dad for OP's support, or will she likely stiff him too?

I certainly wont be going to my father-in-law for anything. I am only concerned with his daughter saying that she wants the money back that she spent while we were married.

You don't understand. FIL sponsored you. If you are unable to support yourself, he is on the hook. WE, the taxpayers, don't want to support a foreign national.

Why are you divorcing your wife? Might make more sense to tough it out until you can be naturalized.
