The boys parents are all for it. She has helped calm him down and make him behave much better than he has in recent times.

They don't seem to think there is anything wrong with it at all. Of course, he can't get pregnant. And their way of raising him... well... he's been alone for a good portion of his life. So I don't think there is any help available there.
They are IDIOTS and you, sir are not far behind! Wait till they get to visit sonny boy in prison.

Call the father and let him know what is happening. Perhaps he will file for custody change. Let your wife know that you are no longer willing to quietly assist her in the sexual molestation of her daughter. Let her know that YOU will notify CPS if necessary.

I would also suggest if staying married to such a negligent woman is a good idea. If this man molests your s-daughter YOU will face felony criminal charges as well.
agreed, because while dad's house may not be perfect- at least the child wont be sexually molested with parental permission.

And I promise, they are doing more than kissing. As the parent of 2 teenage girls- if there is kissing, there is petting and maybe more.
I want to believe, but the section you quoted is about sexual abuse by a person responsible for a youth. Not about another kid. I hope it applies, but I know the law is very nit picky.

Yes, I agree about kissing. Again, I'm just worried about the nit pickiness of the law. I really want to be able to show her mother a bunch of stuff to prove how legally dangerous this all is and I want to make sure it is right before I do.

And yes, kissing is where it starts. I know. She doesn't believe it, but I certainly do.

the portion I posted for section 12-12 of the criminal code of 1961 has nothing to do with someone responsible for youth. That phrasing comes in when talking about who a mandated reporter is. You are a mandated reporter for this child because you live in the same house with her and are "responsible for the youth". The section 12-12 specifically talks about when the abuser is under 18 (therefore cannot be legally in a postition of responsibility for a minor) and a child under 13

"Sexual conduct" means any intentional or knowing touching or fondling by the victim or the accused, either directly or through clothing, of the sex organs, anus or breast of the victim or the accused, or any part of the body of a child under 13 years of age,

that would include the mouth and tongue.
once she's 13, you may have to wait until he brushes her breast with his hand- which I assure you he is already doing.

Also check out her e-mail, text messages, and FB page to see if sonny has been writing any sexual messages to her...or she to him.

Dump your stupid wife.

my suggestion?

Call child protective services and tell them what is going on. I have found that they can give you a lot of good info.

And it may be a good shock for mom, kiddo, and perv to get a little visit from CPS to realize that this is not all fun and games and that it is illegal.

So, technically they can kiss when she is 13- UNTIL he turns 18. When he turns 18- things get WAY WORSE FOR HIM!!!!! (we havent even posted those laws on here)

Perv is looking at felony child molestation charges for even kissing her at that point.

And maybe that is exactly what CPS needs to sit down and explain to kiddo, mom, perv, and his parents.

I wish that were the case. I really do.

But she is left alone with teenage boys all the time there. She has already spent the night (in her step brothers room) in a bed with a 15 year old friend of the brother. The brother was asleep. She says nothing happened. We'll never know for sure.

That house is unsupervised. The adults drink all the time. They used to (and may still) do drugs.

Her mother may be acting stupidly and negligently, but she thinks she is doing the right thing. She is wrong, but she is trying. At the dad's house they don't even try.

I was reading from the PDF you linked. It is called IL Minor Consent. I searched in it for the line you quoted and only found it in one location, the one I mentioned. I didn't look in the Criminal Code of 1961 for it because I didn't think that was what you were talking about. Sorry for the miscommunication.

email, texts, etc... are covered. I see them all. Nothing yet other than professing how much they love each other.

If I dump my wife I lose my girl too.

I would much rather educate my wife and move forward, keeping my family intact.

As I said, no interest in a fight. I came here to get legal advice to find ways to stop this. If that makes me an idiot, so be it.
How about you take Mom and DD to a GOOD criminal attorney and get the facts of life. Mom will have to hear ALL the legal repercussions of her GROSS criminal negligence and criminal child endangerment.

Daughter will hear what will happen to her "boy"friend when she considers sneaking off with him.

Cost of a good attorney=$500.00 per hour

Cost of NOT ending up with criminal charges and an unexpected grandchild= priceless.

I think you need to have someone else educate your wife- like a social worker (CPS) or a police officer.

It seems mom (and probably kiddo) need a BIG WAKE UP CALL before things get really out of hand and someone ends up prego, in jail, labeled a life long sex offender, loses custody, or gets brought up on criminal charges.
ALL OF THOSE ARE POSSIBILITIES (and much more)
