What part of 'minor' do you not understand? It most certainly is NOT a victimless crime. The minor is unable to legally consent to having sex with someone of that age. It is statutory rape or whatever words are used to describe the crime in that state.

The fact that it would be legal if they lived somewhere else is irrelevant. They don't live somewhere else. You don't get to choose which laws to follow.
I'm talking about the moral side of it. Off course legally it's a crime.
It just not making any sense for me as a third party that I need to consider 19/16 as a "rape", "Child molestation" etc, and if it's going on 100 feet away in Nevada with Nevada residents, I need to change my moral values on this matter 180 degrees.

Frankly, no one cares how low your values are.

That's not what you said. You said that 100 yards away it isn't a crime... thereby saying that it shouldn't be a crime here.

Awesome.

Another person that thinks their opinion should have some relevance on a legal website.

You really have no idea what we do here, right?

No. I did not say it. People of California have the right to have their own laws.

You started with crazy and hysterical tone about this case, as there was a 2 yo toddler molested. I just want to calm things down.

So, at what age do YOU feel comfortable in terms of child rape? What is that magic age where you start to think it is okay?

California? They say 18.

I am hardly hysterical. I just think that people that are willing to enable a child's rape so that they don't have to get a new roommate are beyond belief. Do you want to bet me whether or not the child was raped again LAST night?

There is no reason to calm this down. A child is being abused and you want to calm down and discuss it. I don't believe a discussion is necessary.... and I certainly don't need to hear you help the OP rationalize why NOT calling the police is really okay.

this is a thread where the last thing needed is to "calm things down"

I hope he thinks being evicted for this illegal activity, is easier then "finding a new roommate"

He needs to call the police or stop to be involved in this case just because it's illegal. It doesn't matter what do I or he thinks. It's illegal, end of story. When dealing with the law we need to put are personal opinions aside.
If you ask me individually for my personal opinion, I would suggest the following:
Under 14: Statutory rape if the partner is older more than one year (felony).
Between 14-16: Statutory rape if the partner is older more than 2 years (misdemeanor).
Between 14-16: Statutory rape if the partner is older more than 4 years (felony).
Between 16-18: Statutory rape if the partner is in position of power: Teacher, parent, cop, priest etc (felony).

You mean like your statements about how it SHOULD be legal and WOULD be legal in other states?

I agree.

If you ask me individually for my personal opinion, I would suggest the following:
Didn't you JUST say that we should keep opinions out of this? Rarely do we get a person that contradicts themselves from one line to the next.

Under 14: Statutory rape if the partner is older more than one year (felony).
Between 14-16: Statutory rape if the partner is older more than 2 years (misdemeanor).
Between 14-16: Statutory rape if the partner is older more than 4 years (felony).

Write your congressman.

Exactly. But if you starting to express your opinion by describing an unlawful intercourse as it was a hardcore terrible child rape, I have the right to oppose it.
HELLO!! MCFLY!!!

The difference is, his opinion happens to be a legal fact, and your oppinion is condoning the statutory rape of children.

how about you just go away.

Alex, no matter how you slice it, rape occurs when there is sex without consent. That does NOT just mean forcible rape - it also means when one of the actor is unable to giving consent. A 16 year old in CA by law MAY NOT give consent for sex. Therefore, this is sex without consent. Therefore, it is rape by law whether you like it or not.

OP knows that. He just doesn't think the law should apply to his roommate. I just can't quite figure out if his rationalization is that it's too hard to find another roommate or that they could pick up the entire house and move it across the border and the law would be different.
