Need advice in Cali!!

What part of 'minor' do you not understand? It most certainly is NOT a victimless crime. The minor is unable to legally consent to having sex with someone of that age. It is statutory rape or whatever words are used to describe the crime in that state.

The fact that it would be legal if they lived somewhere else is irrelevant. They don't live somewhere else. You don't get to choose which laws to follow.

I'm talking about the moral side of it. Off course legally it's a crime.
It just not making any sense for me as a third party that I need to consider 19/16 as a "rape", "Child molestation" etc, and if it's going on 100 feet away in Nevada with Nevada residents, I need to change my moral values on this matter 180 degrees.

I am hardly hysterical. I just think that people that are willing to enable a child's rape so that they don't have to get a new roommate are beyond belief. Do you want to bet me whether or not the child was raped again LAST night?

There is no reason to calm this down. A child is being abused and you want to calm down and discuss it. I don't believe a discussion is necessary.... and I certainly don't need to hear you help the OP rationalize why NOT calling the police is really okay.

If you ask me individually for my personal opinion, I would suggest the following:
Under 14: Statutory rape if the partner is older more than one year (felony).
Between 14-16: Statutory rape if the partner is older more than 2 years (misdemeanor).
Between 14-16: Statutory rape if the partner is older more than 4 years (felony).
Between 16-18: Statutory rape if the partner is in position of power: Teacher, parent, cop, priest etc (felony).

A 16 year old in CA by law MAY NOT give consent for sex. Therefore, this is sex without consent. Therefore, it is rape by law whether you like it or not.

OP knows that. He just doesn't think the law should apply to his roommate. I just can't quite figure out if his rationalization is that it's too hard to find another roommate or that they could pick up the entire house and move it across the border and the law would be different.
