First of all, you don't sue to get somebody fired. You sue for $$money$$.

Secondly, you have been given the legal definition of a HWE several times and apparently think it doesn't apply to you.

You have been told the legal definition of a hostile workplace. It takes more than your manager being a world-class jerk. Since he is not doing anything illegal, you have no grounds for a class action suit or any other kind of suit, no matter how much documentation you have.

But if it's going to take your paying for several lawyers to tell you that before you believe what we've told you for free, so be it.

OK, assuming everything the OP is saying is true, then why did he/she consult here before seeing his/her friend "lawyer" person?

I wanted opinions from other lawyers.

Money is not what we are after. However if filing a harassment lawsuit leads to a monetary award. So be it.

We want this manager gone. Everyone is tired of being harassed. And yes we have a case due to several of the people being harassed are women and in the "protected" group.

I thought you said you had a case because bullying is illegal?

That said, just because they happen to be women doesn't make their treatment illegal. In fact, if this boss is treating them the same way he treats everyone else, that proves they don't have an illegal harassment case. (And even if they did, you certainly don't...unless you're going to tell us that you're actually a woman yourself?)

Unless they are being bullied BECAUSE they are women, no, they don't have a case.

And if he's bullying EVERYONE, that works against your having any kind of case because it proves he's NOT bullying them BECAUSE they are women.

You really don't get it, do you?

You can't sue to get your manager fired as no court can order an employer to fire somebody. You sue for money.

Is there any part of this that is not clear?

Having read all the other replies, I'm sure I'm spittin' into the wind but here goes...

Jason, you and your co-workers do not have any kind of lawsuit to bring against the company because the boss is a jerk. There simply is no legal means by which you can force your employer to fire this guy.

What you describe does not constitute a hostile work environment in the law nor is the boss being a bully prohibited in Illinois, any other State, or under federal law. Nothing you describe consitutes any form of prohibited discrimination. Being a jerk towards everybody (male/female, white/hispanic/black, young/old, Christian/Jewish/Muslim) is completely legal.

Since you're convinced that you have the basis of a lawsuit, then please spend several hundred dollars and have an employment law attorney tell you the same thing everybody here has explained repeatedly for free. Whatever attorney you claim to have already spoken with clearly knows nothing about employment law.
