medical coverage problem

Have you contacted your ex's insurance and asked them about "guesting"? I had this same situation with my husband's HMO insurance in CA and his kids were out of state. The insurance was able to "guest" them into a medical group in their area so they could use his California HMO in another state. Many insurance companies can do this if they do business in that particular state with kids that are away at college and for situations such as these.

Its worth a try and like I said it worked for my step kids who are in another state with no problems.

Thanks Concerned,

That is what we had previously. His employer no longer offers a plan that allows guesting.

My biggest fear is that our pediatrician won't accept the children without insurance. Can the refuse to treat if pay for services directly? Does anyone know?

I have not seen a doctor that doesnt accept cash payments. In fact some offer discounts if you are a cash payor. But they can obviously refuse to see you or treat you if you dont pay them, up front. Its emergency rooms that cant refuse to see/treat you if you have no money.

But please dont use an ER as a dr. office...

insurance problems worse

Thanks for the previous advice. I ended up purchasing coverage for my son only as he has ongoing medical issues. I turns out that the insurance is horrible and doesn't cover any of his ADHD medications ($175.00 month). Now my job no longer offers insurance coverage. I was wondering if I try and get my children covered under the state plan for low income parents (Kidscare) if I would need to go back to court. The NCP's child support payments were calculated in part on the $600 a month he was paying for insurance (I think that's for him and the kids together). So if I make this change he would need to increase child support payments correct?

I dread going back to court but medical costs are killing me. My question is what are the benefits on going on the State plan (and would they consider my ex's ability to afford medical coverage and disallow my application based on that?) Thanks for any advice.

No, he would not need to increase HIS child support payments if YOU decide to get the children on Kidscare because HE is still providing insurance. He is doing nothing wrong and everything according to the court order. You moved from CA, right?

They moved 6 years ago and dad's insurance doesn't cover the children in their home state of residence.

Mom, go ahead and try to get the children on state insurance. Explain the situation to them thoroughly.

But she can't expect dad to pay MORE in child support because SHE moved and his insurance changed. He is still covering the children.

No, but if the orders are changed so that she provides the insurance, then any CS credit that dad got for providing the insurance would revert to her (assuming that she has to pay something for the state insurance or any other insurance)...which effectively would raise dad's child support.

Dad would not be paying more altogether because he would no longer be paying for insurance (unless he chose to do so) but he would be paying mom more because she would get the insurance credit.

Thanks for your responses. CS was calculated using dissomaster *after* the move to California was approved by the Court. It includes dad's credit for insurance. That's why I think this may change the support amount.

But it depends on whether KidsCare will allow me to enroll the kids here in Illinois if their Dad keeps them on his insurance in CA. That insurance used to allow guesting and worked perfectly. Now it only covers ER visits. Our son has almost weekly medical/psychological apts and expensive medication. And none of his current doctors accept Kidscare. Dad says he will look into insurance for next enrollment period (8 months from now) that has a large deductible that covers both states.

I don't want to go back to court but it may be the only way to keep things fair (dissomaster fair) regarding support.
