I seriously doubt that CPS or the state is going to intervene because someone has HBO/Showtime/etc. in the kid's room.
Was it a mistake not to put proper parental controls on it? Yes. Was it intentional? I doubt it.
I suspect that the OP has since corrected that mistake. At least, I hope so.
Whether any of us might chose to put satellite or cable TV in a young child's room is beside the point. The OP had a right to do that and there is something to be said about doing that. The issue would be whether or not the parent knowingly allowed or exposed the child to pornographic images. That does not seem to be the case.
I refuse to castigate the OP for having TV in their child's room. It's not something I might do, but I an see some advantages in it. And, I for one, have also forgotten to put controls on access to my Direct TV or HBO Go and found kids watching inappropriate stuff on the TV or internet until I DID make those changes. But, like the OP, it didn't really occur to me until after I found out about it.
My concern here is whether or not the child has had some other exposure that the OP is unaware of.
