Geez guys... that's very hateful...

I am not lying... We are BOTH the wife... we were married in a same sex relationship. I just wanted to keep things simple without going into a "married but same sex" adding to the story and perhaps getting bias...

This was a 9 year marriage.... we have been in the house 6 years, this is our second home together.
In 2002 California did NOT recognize same sex marriages. Therefore YOU are not legally married. Even if you were legally married in another state/country, DOMA states that full faith and credit does NOT apply and therefore you do not qualify for a divorce.

We did our Domestic Partnership in 2002 and then in 2008 when Gavin Newsome allowed Gay Marriage in 2008 we got our Marriage License. Like straight couples, gay couples split and divorce. I did not want this to end up being a bash the gays which is why I omitted the fact that we are same sex, and get off topic.

Either way... we went through a FULL BLOWN - "Divorce". Our MSA (which I can forward to you privately to PROVE that I am not a liar) states "Marriage Dissolution".

You guys are very jaded...

Then you have NOT been married 9 years. You have been married 3, maybe. And therefore you are not entitled to the house at all. Your biggest issue is by hiding the FULL truth, you have lost credibility and received IMPROPER advice because you lied about your situation.

None of the seniors "bash the gays" as you state. In fact we report posts in which that happens. Everything you have been told on here is not accurate quite frankly because we started with incorrect, inaccurate information.

I am sure you know in many ways a "Domestic Partnership" holds the same weight legally as a "Marriage"... My Marriage Settlement Agreement and all of our court papers recognizes the our actual dates of and I quote "MARRIAGE" as 9 years ago. It doesn't even mention our actual Marriage is Sn Francisco it goes back to our DP. I didn't want to get bias, I didn't want to get "off topic" because all my legal paperwork states "marriage" and "divorce" therefore I didn't think it relevant. I will be happy to privately forward my papers to you...

This is just plain MEAN spirited.

Do what ever your little heart desires. I am not being mean. The problem is the laws are different -- however "minor" the differences may be. It would not have been BIAS but it would have been honest for you to state everything up front.

You must be ashamed of who you are, had you not been you would not have cared what others thought ~ the facts would have still been the facts. We are not jaded. I for one, don't appreciate being lied to.

Just so you know. I believe that as long as two people love each other and are committed to one another, the mechanics of their body parts don't matter.

OP, the real answer is, you need a lawyer. This has gotten far too messed up for you to handle on your own.
